SUMMARY

The applicant is requesting a recommendation of approval for a New Series 12 (Restaurant) liquor license.

Recommendation

Recommend approval to the Arizona Department of Liquor Licenses and Control (DLLC) of Application No. 197154, a request by April Risa Hirschi, agent for BJ'S Restaurant & Brewhouse, for a New Series 12 liquor license. BJ'S Restaurant & Brewhouse is located at 14950 W. McDowell Rd., Goodyear, Arizona 85395, generally located on the Northeast corner of 150th Drive and McDowell Road. (Darcie McCracken, City Clerk)

FISCAL IMPACT

The applicant paid the $635 application fee for the liquor license per the Goodyear Municipal User Fee Schedule. The business will also contribute to the tax base of the community.

BACKGROUND AND PREVIOUS ACTIONS

Ms. Hirschi has applied for a New Series 12 liquor license for BJ'S Restaurant & Brewhouse, which is currently under construction with an anticipated opening date in September 2022. BJ'S Restaurant & Brewhouse will be a full-service restaurant and is the 7th location in Arizona, with the other restaurants located in Chandler, Mesa, Peoria, Phoenix, and the Tucson area. 

The City Clerk's Office received the application from the Arizona Department of Liquor Licenses and Control on June 6, 2022. A public notice was posted on the property on June 13, 2022, to comply with Arizona Revised Statutes §4-201(b). No petitions or protests from qualified persons were received during the comment period.

STAFF ANALYSIS

A Series 12 license is for a restaurant and is non-transferrable. This on-sale retail privileges liquor license allows the holder to sell and serve all types of spirituous liquor solely for consumption on the premises of an establishment that derives at least forty percent (40%) of its gross revenue from the sale of food. The DLLC requires license owners, agents, and managers actively involved in the day-to-day operations of the business to complete a state-approved management training course prior to the issuance of a liquor license. Ms. Hirschi has completed her State training and Certification and stated that the restaurant has an in-depth internal responsible alcohol service program aimed to prevent the sale to minors and over-service of guests. A manager will be present on-site during all business hours. She also stated that their policy is to ask for identification from anyone who appears to be under 30 years of age, and all staff will be trained to understand and follow the guidelines of Arizona liquor license laws to avoid selling alcohol to minors. She added that BJ’s Restaurant & Brewhouse has successfully operated over 210 locations in 29 states and look forward to coming to Goodyear, Arizona.

There are no licensed childcare facilities, K-12 schools, or churches within 300 feet of the location.

The City Council's recommendation of "Approval", "Disapproval" or "No Recommendation" will be forwarded to the DLLC for consideration during their licensing review process
