SUMMARY

The applicant is requesting recommendation of approval for a New Series 12 (Restaurant) liquor license.

Recommendation

Recommend approval to the Arizona Department of Liquor Licenses and Control (DLLC) of Application No. 198840, a request by Manuel De Jesus Herrera Jr., agent/applicant for El Tataki Sushi Fusion Express, for a new Series 12 liquor license. El Tataki Sushi Fusion Express is located at 790 N. Estrella Parkway #D & #E., Goodyear, AZ 85338 generally located on the southwest corner of Estrella Parkway and Roosevelt. FISCAL IMPACT

The applicant paid the $635 application fee for the liquor license per the Goodyear Municipal User Fee Schedule. The business will also contribute to the tax base of the community.

BACKGROUND AND PREVIOUS ACTIONS

Mr. Herrra has applied for a New Series 12 liquor license for El Tataki Sushi Fusion Express, which is currently open for business but not selling alcohol. El Tataki Sushi Fusion Express will be a full-service restaurant and is the 2nd location in the Phoenix Metro Area, with a future location in Tempe.

The City Clerk's Office received the application from the Arizona Department of Liquor Licenses and Control on June 14, 2022. A public notice was posted on the property on June 21, 2022, to comply with Arizona Revised Statutes §4-201(b). No petitions or protests from qualified persons were received during the comment period.

The application was routed to the Police Department and the Development Services Department (Planning and Zoning, Code Compliance, and Building Safety), and any comments from these departments are listed below:

STAFF ANALYSIS

A Series 12 license is for a restaurant and is non-transferrable. This on-sale retail privileges liquor license allows the holder to sell and serve all types of spirituous liquor solely for consumption on the premises of an establishment that derives at least forty percent (40%) of its gross revenue from the sale of food. The DLLC requires license owners, agents, and managers actively involved in the business's day-to-day operations to complete a state-approved management training course before issuing a liquor license. Mr. Herrera and employees have completed the State training and Certification. He states the restaurant has an in-depth internal responsible alcohol service program aimed to prevent the sale to minors and over-service of guests. A manager will be present on-site during all business hours. He also stated that their policy is to ask for identification from anyone who appears to be under 40 years of age, and all staff will be trained to understand and follow the guidelines of Arizona liquor license laws to avoid selling alcohol to minors. 

There are no licensed childcare facilities, K-12 schools, or churches within 300 feet of the location.

The City Council's recommendation of "Approval", "Disapproval" or "No Recommendation" will be forwarded to the DLLC for consideration during their licensing review process.
