SUMMARY
Acceptance of a Special Warranty Deed from Estrella North LLC, a Delaware limited liability company for the Sendero Lift Station servicing the Lucero Community 11 development.
Recommendation
Accept the Special Warranty Deed for the Sendero Lift Station from Estrella North LLC, a Delaware limited liability company. (Linda Beals, Real Estate Coordinator)
FISCAL IMPACT
There will be no fiscal impact to the City in the fiscal year 2023 or in future years with the acceptance of this special warranty deed.
BACKGROUND AND PREVIOUS ACTIONS
Estrella North LLC, a Delaware limited liability company “Estrella North” is the owner of certain property within Estrella (formerly Estrella Mountain Ranch) that is commonly referred to as Lucero or Community 11. Estrella North is moving forward with the development of Community 11 and the construction of public infrastructure, including the construction of a lift station known as the Sendero Lift Station.
STAFF ANALYSIS
The Sendero Lift Station is a critical component of the infrastructure needed for the city to provide wastewater services to Community 11. The city is to own and operate the lift station following its completion. Accordingly, City ownership of the site upon which the lift station is to be located is required. Staff has reviewed the construction plans for the lift station and has confirmed that the property described in the attached special warranty deed is the property needed for the sewer lift station site. Staff recommends Council acceptance of the Special Warranty deed attached hereto.
