SUBJECT: APPROVE AN INTERGOVERNMENTAL AGREEMENT WITH THE STATE OF ARIZONA ESTABLISHING MAINTENANCE RESPONSIBILITIES FOR LANDSCAPING AND ROADWAYS NEAR INTERSTATE 10 AND STATE ROUTE 303 AND ASSOCIATED BUDGET AMENDMENT.

SUMMARY

Request Council approve an Intergovernmental Agreement (IGA) with the Arizona Department of Transportation (ADOT) establishing maintenance responsibilities for landscaping and roadways near Interstate 10 and State Route 303.

Recommendation

Approve an Intergovernmental Agreement with the State of Arizona establishing maintenance responsibilities for landscaping and roadways near Interstate 10 and State Route 303 and associated Budget Amendments. (Hugh Bigalk, P.E., City Traffic Engineer)

FISCAL IMPACT

The approval of the IGA will have an impact to city maintenance operations.  The anticipated annual expenses have been illustrated in Table 1.

Additional landscaping maintenance is anticipated to be $113,894 for the Parks Department and additional sidewalk maintenance is estimated at $44,676 for the Engineering Department, assuming replacement of 3% of the total sidewalk area per year.  A budget amendment increasing the P&R ongoing maintenance budget in the amount of $113,900 is required. Sidewalk maintenance costs are not anticipated in FY2023 - no budget amendment is required.
 

BACKGROUND AND PREVIOUS ACTIONS

As each interchange or groups of interchanges have been developed by ADOT along Interstate 10 and State Route 303, an IGA has been executed between ADOT and the city defining responsibility for the pavement, sidewalks, curbs, traffic signals, litter removal, and landscaping at the interchanges. 

STAFF ANALYSIS

The purpose of this IGA is to consolidate several individual IGAs into one document and to clarify maintenance responsibilities between ADOT and the city.  ADOT has experienced challenges in maintaining a high level of service for items such as landscaping.  They continue to maintain the landscaping but at a decreased number of times per year.

This IGA would shift some responsibilities from ADOT to the city in order to provide a higher standard of care compared to today.  Primarily, landscaping maintenance and minor sidewalk maintenance along the arterial street shift from ADOT to the city.  It does not shift any maintenance responsibility along the freeway ramps or the mainline.  The calculated area for both landscaping and sidewalk is illustrated in Table 2.

Items such as concrete pavement, retaining walls, fencing in the vicinity of the interchange would remain the responsibility of ADOT.  Landscaping maintenance, sidewalks, litter removal, weed removal, arterial street pavement marking and signs would become the responsibility of the city. ADOT has also informed us that they require entering into such agreements with all municipalities before extending or improving highways in those jurisdictions.
