SUBJECT: FINAL PLAT FOR CHEDDAR'S SCRATCH KITCHEN

SUMMARY

A replat of Lot 1 Estrella Falls Regional Shopping Center and a replat of Lot 11 of Replat of Lot 9. The replat will subdivide and reconfigure the 2 existing lots totaling 5.078 acres into 3 lots. Cheddar’s Scratch Kitchen is located at the northeast corner of North 150th Drive and West McDowell Road within the Goodyear Planned Regional Center Planned Area Development.

Recommendation

Approve the Final Plat for Cheddar’s Scratch Kitchen. (Stephen Scinto, Deputy Director of Development Engineering)

STIPULATIONS

1. Prior to recordation of the final plat, Owner shall submit an updated title report for the Property and shall modify this plat to reflect the current ownership and current lender including on the final plat a Lender Consent and Subordination in a form approved by the City Attorney or his/her designee for all lenders with a security interest in the property being platted herein. Owner shall provide documentation acceptable to the City Attorney or his/her designee demonstrating that the party executing this final plat is authorized to do so;
2. Any technical corrections to this final plat required by the City Engineer or his designee shall be made prior to the recordation of the Final Plat;

FISCAL IMPACT

Although a fiscal impact analysis has not been conducted on this specific project, all new development will have an ongoing fiscal impact on the City. The development is responsible for construction of all infrastructure necessary to serve the site and will generate one-time revenue for the City through payment of permits, construction sales tax and development impact fees. Longer term fiscal impacts include increased demands for municipal services, the costs of which may or may not be offset by increased property values/tax levies, city sales tax, state shared revenues and the increased demand for commercial and retail development. Any areas that will be maintained by the city are constructed by the developer and then conveyed to the city two years after construction.

BACKGROUND AND PREVIOUS ACTIONS

The subject property is a part of the Goodyear Planned Regional Center Planned Area Development (PAD). The PAD was approved on February 14, 2000, with City Council adoption of Ordinance No. 2000-0679.
The Final Plat for Estrella Falls Regional Shopping Center was approved by the City Council on September 24, 2007. (Recorded Book 996 Page 38), which created nine (9) lots (1-9).
The Final Plat – A Replat of Lot 9 of Estrella Falls Regional Shopping Center were approved by the City Council on August 22, 2016 (Recorded Book 1271 Page 7), which split Lot 9 into three (3) lots (9, 10, and 11) and on tract (Tract A).

STAFF ANALYSIS

This replat will subdivide and reconfigure Lot 1 created by the Estrella Falls Regional Shopping Center and Lot 11 created by the Replat of Lot 9 of the Final Plat of Estrella Falls Regional Shopping Center.  Lot 1 and Lot 11 have a combined acreage of 5.078.  This replat will create three lots from these existing two lots.

The replat, subject to the stipulations herein, conforms to the lot yield, street configuration and utilities as established with the approved final plat, attached hereto, and is consistent with the technical requirements of the city’s subdivision regulations and engineering standards. The Final Plat is in substantial conformance with the Preliminary Plat.
