SUMMARY
A replat of Lot 1 of a Minor Land Division for Tradecor Partners Goodyear, LLC and Goodyear Lodging Investors I, LLC to subdivide existing Lot 1, a 5.830 acre lot located at the southwest corner of McDowell Road and Bullard Avenue, into three (3) lots.
Recommendation
Approve the final plat for QuikTrip Store #1417 subdividing approximately 5.83 acres located at the southwest corner of McDowell Road and Bullard Avenue (the “Property”) subject to stipulations. (Steve Scinto, Deputy Director of Development Engineering)
STIPULATIONS
- Any technical corrections to this final plat required by the City Engineer or his designee shall be made prior to the recordation of the Final Plat; and
- Prior to recordation of the final plat, Owner shall submit an updated title report for the Property and shall modify this plat to reflect the current ownership and current lender including on the final plat a Lender Consent and Subordination in a form approved by the City Attorney or his/her designee for all lenders with a security interest in the property being platted herein. Owner shall provide documentation acceptable to the City Attorney or his/her designee demonstrating that the party executing this final plat is authorized to do so; and
- Prior recordation of the Final Plat the reference in Lot 1 and Lot 2 to the 12’ Sewer Easement by Separate Instrument shall be replaced with: 12’ Private Sewer Easement by Separate Instrument and the reference to the 12’ Sewer Easement per DOC 2021-0832401 shall be replaced with 12’ Private Sewer Easement per DOC 2021-0832401; and
- Prior to recordation of the Final Plat, the Temporary Drainage Easement reflected on the Final Plat that is to be conveyed by separate instrument shall be conveyed to the City and recorded in the official records of the Maricopa County Recorder and the recording information inserted on to the Final Plat. The easement shall be lien free and free from all other encumbrances unless approved by the City Engineer or his/her designee and shall be in a form approved by the City Attorney of his designee; and
- Prior to recordation of the final plat, the Private Irrigation Easement reflected on the Final Plat that is to be conveyed by separate instrument shall be conveyed to the appropriate entity and recorded in the official records of the Maricopa County Recorder and the recording information inserted on to the Final Plat; and
- Prior to recordation of the Final Plat, the Private Water Easement reflected on the Final Plat that is to be conveyed by separate instrument shall be conveyed to the appropriate entities and recorded in the official records of the Maricopa County Recorder and the recording information inserted on to the Final Plat; and
- Prior to recordation of the Final Plat, the 12’ Sewer Easement (to be renamed 12’ Private Sewer Easement) reflected on the Final Plat that is to be conveyed by separate instrument shall be conveyed to the appropriate entities and recorded in the official records of the Maricopa County Recorder and the recording information inserted on to the Final Plat; and
- Owner shall construct all infrastructure improvements required by the City of Goodyear subdivision regulations and Engineering Design Standards and Policy Manual in effect at the time of construction.
FISCAL IMPACT
Although a fiscal impact analysis has not been conducted on this specific project, all new development will have an ongoing fiscal impact on the city. The development is responsible for construction of infrastructure necessary to serve the site and will generate one-time revenue for the city through payment of permits, construction sales tax and development impact fees. Longer term fiscal impacts include increased demands for municipal services, the costs of which may or may not be offset by increased property values/tax levies, city sales tax, state shared revenues and the increased demand for commercial and retail development. Any areas that will be maintained by the city are constructed by the developer and then conveyed to the city two years after construction.
BACKGROUND AND PREVIOUS ACTIONS
On May 14, 2007, the Property was rezoned from AG (Agricultural) to C-2 (General Commercial) by Ordinance No. 07-1070. On May 21, 2008 the city approved a Minor Land Division for Tradecor Partners Goodyear, LLC and Goodyear Lodging Investors I, LLC, which was recorded in the official records of the Maricopa County Recorder at Book 990 of Maps Page 5 (the “MLD”). The MLD created three (3) lots. The Property is Lot 1 of the MLD, which is being re-platted to create three (3) lots.
The Preliminary Plat for Quiktrip Store #1417 was approved on July 19, 2021. A site plan for the development of a QuikTrip on Lot 1 within the Final Plat for Quiktrip Store #1417 and a Use Permit for the development of the Quiktrip was approved on July 30, 2021 (Case No. 21-600-00038).
The Preliminary Plat for Quiktrip Store #1417 was approved on July 19, 2021. A site plan for the development of a QuikTrip on Lot 1 within the Final Plat for Quiktrip Store #1417 and a Use Permit for the development of the Quiktrip was approved on July 30, 2021 (Case No. 21-600-00038).
STAFF ANALYSIS
The final plat substantially conforms to the approved preliminary plat and is consistent with the technical requirements of the city’s subdivision regulations and engineering standards and provides for the orderly development of the property by identifying the required infrastructure needed to serve the development. As set forth in the attached preliminary plat Council Action Report, the proposed subdivision is consistent with the General Plan and will not adversely impact the surrounding area.
