SUMMARY
Approval of this item will amend Goodyear City Code Section 11-1-28, Unruly Gatherings, to correct some typographical errors previously presented and approved by Council on July 18, 2022.
Recommendation
1. ADOPT RESOLUTION NO. 2022-2277, DECLARING A PUBLIC RECORD THAT CERTAIN DOCUMENT FILED WITH THE CITY CLERK AND TITLED "AMENDMENT TO GOODYEAR CITY CODE OF ORDINANCES CHAPTER 11-OFFENSES, SECTION 11-1-28, AMENDING UNRULY GATHERING REGULATIONS."
2. ADOPT ORDINANCE NO. 2022-1560, ENACTING AN AMENDMENT TO CHAPTER 11 OF THE CITY OF GOODYEAR CODE OF ORDINANCES, AMENDING REGULATIONS IN SECTION 11-1-28, UNRULY GATHERINGS; PROVIDING FOR CORRECTIONS; SEVERABILITY; AND AN EFFECTIVE DATE. (Jay Karlovich, Assistant City Attorney)

FISCAL IMPACT
There is no anticipated fiscal impact. Any fees received from potential violations of the ordinance are expected to be nominal.
BACKGROUND AND PREVIOUS ACTIONS
On July 18, 2022, Council approved an amendment to Section 11-1-28 of Goodyear City Code previously entitled “Disorderly party, gathering, event,” which replaced the entire Section 11-1-28 with new regulations and is now entitled “Unruly Gathering.”
Thereafter, City staff realized that the second to last draft version of the Unruly Gathering ordinance was inadvertently uploaded into the agenda system for the July 18, 2022, Council meeting, instead of the final version which is now reflected in the proposed Resolution 2022-2277.

STAFF ANALYSIS
Staff recommends Council adoption of Resolution No. 2022-2277 and Ordinance No. 2022-1560 which will revise Section 11-1-28 of the Goodyear City Code to clarify the “Unruly Gathering” regulations and correct the language to reflect the original intention of the code.
