SUMMARY
Adopt City of Goodyear Drought Preparedness Plan 2022 and amendments to sections 14-5-5 and 14-5-6 of the Goodyear City Code required to ensure consistency between these provisions and the updated Drought Preparedness Plan and to provide flexibility for future modifications of plan.
Recommendation
1. ADOPT ORDINANCE NO. 2022-1546, AMENDING SECTIONS 14-5-5 (VIOLATIONS; PENALTIES) AND 14-5-6 (WATER USE RESTRICTIONS) OF THE GOODYEAR CITY CODE.

FISCAL IMPACT
There is no fiscal impact to the city by adopting the updates to the Drought Preparedness Plan and Ordinance changes.
BACKGROUND AND PREVIOUS ACTIONS
State law requires all water providers to prepare and utilize a Drought Preparedness Plan (DPP). The City of Goodyear’s current drought plan is set forth in the City of Goodyear Water Conservation and Curtailment Plan (WCCP), which was adopted in 2008 and included the city’s water conservation plan. The city’s water conservation plan was incorporated into the city’s Designation of Assured Water Supply adopted in 2016. The city’s DPP is required to be updated by December 31, 2022. Feedback received at the City Council Work Session on October 24 has been incorporated into the plan.
STAFF ANALYSIS
Drought Preparedness Plans are required to identify water use reduction measures to be used to reduce demand to protect essential water uses in the event of water shortages due to operational emergencies or drought. These plans assist city officials in making the necessary decisions during episodes of shortage by defining water supply curtailment stages. They are meant to provide a framework for expedient responses while maintaining the flexibility to respond to each unique water supply reduction event.
The attached City of Goodyear Drought Preparedness Plan 2022, complies with the statutory requirements for a DPP. Although Drought Preparedness Plans are subject to approval of the Director of the Arizona Department of Water Resources (ADWR), staff has been working with representatives of ADWR on its revised DPP and anticipates ADWR approval following its adoption by Council.
Updates to the city’s DPP requires amendments to sections 14-5-5 and 14-5-6 of Chapter 14 of the Goodyear City Code. These amendments are required to ensure consistency between these code provisions and the updated DPP and to provide staff with more flexibility to modify the Drought Preparedness Plan after its adoption by council in response to changing conditions related to water supplies. The revisions to sections 14-5-5 and 14-5-6 are reflected in legislative format in Ordinance 2022-1546.
The City of Goodyear currently has a robust water portfolio. Our ability to provide both groundwater and surface water puts the city in a great position to manage any foreseeable impacts of the current drought. However, this does not negate the need to look for ways of using water efficiently and prepare for unexpected situations. The DPP is a tool the city can use to deal with impacts from any future water shortages and can be implemented over a broad range of circumstances.
