SUMMARY
Accept conveyance of property needed for Bullard Wash.
Recommendation
Accept the Special Warranty Deed from Compass Datacenters PHX I, LLC conveying property needed for Bullard Wash. (Kimberly Romero, Real Estate Coordinator)
FISCAL IMPACT
There will be no fiscal impact on the City with the acquisition of this property in FY2023 or in future years.
BACKGROUND AND PREVIOUS ACTIONS
Pursuant to the conditions of approval for Ordinances 2019-1428 and 2019-1429 and the requirements of the Development Agreement for Compass Data Centers, the owner of the property subject to the aforementioned ordinances and development agreement is required to convey to the city property needed to accommodate flows in the Bullard Wash (the “Bullard Wash Property”).
STAFF ANALYSIS
Compass Datacenters PHX I, LLC (Compass) is the owner of the property subject to Ordinances 2019-1428 and 2019-1429 and the Development Agreement for Compass Data Centers. The special warranty deed attached hereto provides for the conveyance of the Bullard Wash Property as set forth in Ordinances 2019-1428 and 2019-1429 and the Development Agreement for Compass Data Centers. Staff recommends that council accept the conveyance of property described in the special warranty deed attached hereto.
