SUBJECT: TERMINATION AND RELEASE OF EASEMENT RELATED TO THE REPLAT OF PALM VALLEY CROSSING

SUMMARY

The City has been asked to terminate the existing Access Easement dedicated in the replat of Palm Valley Crossings Lots 8 and 9.

Recommendation

Approve the termination of the access easement dedicated to the City in the Replat of Palm Valley Crossings Lots 8 and 9 and authorize and direct the City Manager or designee to execute the Termination and Release of Easement. (Kimberly Romero, Real Estate Coordinator)

FISCAL IMPACT

There will be no fiscal impact on the City in the fiscal year 2023 or in future years with the termination of the existing Access Easement.

BACKGROUND AND PREVIOUS ACTIONS

The City is the beneficiary of that certain Access Easement dedicated pursuant to the Replat of Palm Valley Crossings Lots 8 and 9, recorded in the official records of Maricopa County on March 10, 2020, as Instrument Number 2020-0208056.  The Access Easement provided access to lots 8A, 8B, 8C and 8D created by the Replat of Palm Valley Crossings Lots 8 and 9.

STAFF ANALYSIS

Pursuant to A.R.S. § 9-402, the City Council of the City of Goodyear is vested with the power to dispose of easements owned by the City that are no longer needed.   A Minor Land Division Palm Valley Crossing Lots 6-8 & 12, 13, a copy of which is attached hereto, was administratively approved on September 27, 2002 (the “MLD”).  The MLD, when recorded, will consolidate lots 8A, 8B, 8C and 8D created by the Replat of Palm Valley Crossings Lots 8 and 9 into one lot thereby eliminating the need for the Access Easement.  Accordingly, staff recommends council approve the termination of the Access Easement subject to the recordation of the MLD.
