SUMMARY
90-day extension of approval of Final Plat for La Privada Parcels 3 & 7 Phase 1, which subdivides approximately 52.63 acres at the intersection of W. Yuma Road and N. 183rd Avenue into 131 lots and 23 tracts.

RECOMMENDATION
Approve a 90-day extension of the approval of the Final Plat for La Privada Parcels 3 & 7 Phase 1 approved on January 23, 2023, subject to compliance with the Stipulations set forth in the council action report approving the final plat, which extension shall commence on July 21, 2023, the date of the current approval expiration. FISCAL IMPACT
Although a fiscal impact analysis has not been conducted on this specific project, all new development will have an ongoing fiscal impact on the City. The development is responsible for construction of all infrastructure necessary to serve the site and will generate one-time revenue for the City through payment of permits, construction sales tax and development impact fees. Longer term fiscal impacts include increased demands for municipal services, the costs of which may or may not be offset by increased property values/tax levies, city sales tax, state shared revenues and the increased demand for commercial and retail development. Any areas that will be maintained by the city are constructed by the developer and then conveyed to the city two years after construction.
BACKGROUND AND PREVIOUS ACTIONS
The Preliminary Plat of La Privada Parcels 3 & 7 was approved by the City Council on September 27, 2021. A Final Plat of La Privada Parcels 3 & 7 Phase 1 was approved by the City Council on January 23, 2023. An administrative 90-day extension was approved by staff on April 23, 2023. The current extension expires on July 21, 2023. This request for an extension to extend the approval was received prior to the current recording deadline.
STAFF ANALYSIS
Under the Goodyear City Code, the approval of a final plat expires if the final plat is not recorded within 90-days of the date the final plat was approved. The Final Plat of La Privada Parcels 3 & 7 Phase 1 has not been recorded because the property is being sold to a builder who will be developing the property. Although the current owner of the property, Melcor Developments, Ltd., has been working diligently on the completion of the sale, the purchase and sale have not yet been finalized. Melcor has requested the extension so the sale and purchase can be finalized, at which time the final plat will be recorded.
This is the second 90-day extension requested. Accordingly, Council approval of the requested extension is required per section 15-2-5(I)(1) of the Goodyear City Code. Because there have been no changes to the Subdivision Regulations or the Engineering Design Standards since the January 23rd approval, staff supports approval of the requested 90-day extension.
