SUMMARY

Acceptance of right-of-way needed for traffic signal installation at Hillside Drive and Estrella Parkway

RECOMMENDATION

Authorize the acceptance and execution of a Special Warranty Deed from Estrella North LLC conveying right-of-way needed for the installation of a traffic signal at the intersection of Hillside Drive and Estrella Parkway. (Kevin Spicer, Real Estate Specialist)

FISCAL IMPACT

There is no fiscal impact to the city of accepting the dedication of right-of-way needed for the construction of the traffic signal at the intersection of Hillside Drive and Estrella Parkway. The construction of the traffic signal improvements by the developer will generate one-time revenue for the city through payment of permits and construction sales tax. Upon the acceptance of the traffic signal improvements by the City Engineer, subject to the completion of two-year warranty period, the city will be responsible for maintain the traffic signal improvements.

BACKGROUND AND PREVIOUS ACTIONS

On August 2, 2022, a Traffic Signal Warrant Study was completed with recommendations of installing a traffic light signal at the intersection of Estrella Parkway and Hillside Drive based on data meeting traffic signal warrant 3 “Peak Hour” on the Traffic Signal Warrant Summary Table 1 listed within the study. The construction of the traffic signal requires additional right-of-way on the south side of the intersection, which is being conveyed to the city by the owner of the property, Estrella North LLC. 

It is City policy that traffic light signal installations owned and maintained by the City must be on property owned by the City in Fee Ownership rather than Easement. For this reason, a Dedication in Fee Ownership by Special Warranty Deed is necessary.

The Developer is responsible for constructing the traffic signal. The City will own and maintain the traffic signal.

STAFF ANALYSIS

Estrella North LLC has agreed to convey the right-of-way to the city, in the Special Warranty Deed attached hereto. Council approval is required to accept the conveyance of street and traffic signal right-of-way. Staff is recommending acceptance of Special Warranty Deed granting right-of-way for traffic the signal installation which the City will own and maintain. The acceptance and execution of the Special Warranty Deed attached will facilitate the installation of the traffic light signal and further development at the intersection of Hillside Drive and Estrella Parkway.
