SUBJECT: GRANT OF AN ELECTRICAL LINE EASEMENT TO APS OVER PORTIONS OF DRAINAGE BASINS CITY ACQUIRED FOR DEVELOPMENT OF PARK FACILITIES

SUMMARY

APS has requested that the City grant it an Electrical Line Easement over portions of City-owned properties (“City Parcels”). The Electrical Line Easement that APS has offered to purchase from the City, is part of their Three Rivers 230kV Transmission Line project to upgrade electric service in the Goodyear area. Construction of the new 230,000-volt electric transmission line will ensure greater reliability of their electrical system and provide for future growth.

RECOMMENDATION

Approve and authorize the City Manager to execute the Electrical Line Easement granting APS an easement over portions of the drainage basins owned by the City of Goodyear in exchange for the payment of $240,362.40.(Kimberly Romero SR/WA, Real Estate Coordinator)

FISCAL IMPACT

APS is compensating the City of Goodyear $240,362.40 for the Electrical Line Easement that is to be granted to APS. Upon receipt of the funds, the easement will be signed and recorded. Immediately after recording, a copy of the recorded easement will be emailed to the APS representative, and the original easement mailed to APS. It is the sole responsibility of APS to install, operate, and maintain their facility at no cost to the City. 

BACKGROUND AND PREVIOUS ACTIONS

The City of Goodyear owns parcels (500-04-979B, 500-04-979A, 500-04-004V, 500-04-004U, 500-03-006Z, 500-03-006Y and 500-03-004W) which are located north of the I-10 between Bullard Avenue and Dysart Road. The property was acquired from Maricopa County Flood Control District for the development of public park facilities. City staff is currently working with a designer for the development of the site, which is currently vacant. 

APS submitted an offer to acquire an easement for the installation and operation of high-voltage electrical lines as part of its Three Rivers 230kV Transmission Line Project.  The property is encumbered by various easements, agreements, and deed restrictions that reserve the property for flood control purposes and the property is intended to be developed with public park facilities. Because of the existing encumbrances and the city’s plans for the property required, city and APS staff engaged in substantial negotiations regarding the location of the easement, certain requirements and limitations on the part of APS with respect to the improvements constructed within the Easement Area, and certain requirements and limitations on the part of the City with respect to the park facilities constructed within the Easement Area.  After much consideration and discussion with City staff, including representatives from the parks department, the City Manager’s office, real estate and the legal department, and APS representatives, an agreement was reached that will minimize any conflicts with the design and amenities of the future park facilities and the existing encumbrances on the property.

STAFF ANALYSIS

Staff is recommending acceptance of the offer and granting of the Electrical Line Easement to APS over portions of the City Parcels aforementioned. The granting of the easement will have no impact on the value of the City’s property because the existing encumbrances limit the use of the parcels to open space and park facilities and the terms of the easement preserve the city’s right to develop park facilities within its property.  The grant of this easement will facilitate the installation of the APS overhead electric lines, at its sole cost and expense.
