SUBJECT: MAP OF DEDICATION OF INDIAN SCHOOL ROAD

SUMMARY

A Map of Dedication dedicating approximately 2.597 acres into City right-of-way at the intersection of W. Indian School Road and N. Citrus Road.

RECOMMENDATION

Approve the Map of Dedication for Indian School Road, subject to stipulations. (Marty Crossland, Deputy Director of Development Engineering)

STIPULATIONS

1. All technical corrections to this Map of Dedication for Indian School Road (the “MOD”) required by the City Engineer or his/her designee shall be made prior to the recordation of the MOD;
2. Prior to recordation of the Map of Dedication for Indian School Road (the “MOD”), the property owners shall submit an updated title report for the property being conveyed to the City in the MOD and shall modify the MOD to reflect the current ownership and current lender information.  The Lender Consent and Subordination, if required, shall be in a form approved by the City Attorney or his/her designee for all lenders with a security interest in the property being conveyed to the City in this MOD. Owners of the property being conveyed to the City shall provide documentation acceptable to the City Attorney or his/her designee demonstrating that the party executing this final plat is authorized to do so.

FISCAL IMPACT

Although a fiscal impact analysis has not been conducted on this specific project, all new development will have an ongoing fiscal impact on the City. The development is responsible for construction of all infrastructure necessary to serve the site and will generate one-time revenue for the City through payment of permits, construction sales tax and development impact fees. Longer term fiscal impacts include increased demands for municipal services, the costs of which may or may not be offset by increased property values/tax levies, city sales tax, state shared revenues and the increased demand for commercial and retail development. Any areas that will be maintained by the city are constructed by the developer and then conveyed to the city two years after construction.

BACKGROUND AND PREVIOUS ACTIONS

The property being conveyed to the city is located within a portion of land located at the northeast corner of Indian School and Citrus Road.  It was rezoned by Ordinance 2023-1588, which was adopted by the City Council on October 30, 2023.  Under the terms of the rezoning, the owner(s) of the property rezoned by Ordinance 2023-1588 are required to dedicate 65 feet of right-of-way for the north half of W. Indian School Road between North Citrus Road and the eastern boundary of the property rezoned by Ordinance 2023-1588 and to construct all improvements required for a Major Arterial, except for ½ of a median and median landscaping, required for the completion of the full half-street improvements for the north half of the section of Indian School Road. An unaffiliated third-party will be constructing all or part of the improvements the owner(s) of the property subject to Ordinance 2023-1588 is required to construct, and by this map of dedication the owner(s) are dedicating the right of way needed for the portion of the improvements being constructed by the third-party.

STAFF ANALYSIS

The proposed Map of Dedication dedicates the right of way needed for the construction of a portion of the north half-street improvements to W. Indian School Road that the owner(s) of the property rezoned by Ordinance 2023-1588 are required to construct that a third-party will be constructing.  Staff is recommending the approval of the Map of Dedication of Indian School Road subject to the stipulations set forth herein.
