SUMMARY
The City has been asked to terminate portions of the sidewalk easements dedicated to the City on W. Monte Vista Rd. These partial sidewalk easement areas are no longer needed as the office building that was developed on the property adjacent to the Easement Termination Areas encroaches over the Easement Termination Areas.

RECOMMENDATION
Approve the Partial Termination and Release of Easement, terminating and releasing portions of an existing sidewalk easement no longer needed and authorize its execution by the City Manager and recordation with the Maricopa County Recorder. (Colton Blyle, Real Estate Services Specialist)
FISCAL IMPACT
There will be no fiscal impact to the City in the fiscal year 2025 or future years related to the partial release of the portions of the sidewalk easements being terminated.
BACKGROUND AND PREVIOUS ACTIONS
On November 1, 2007 the Map of Dedication for McDowell Road Commercial Corridor Improvement District Infrastructure was recorded with Maricopa County. The Map of Dedication included sidewalk easements over two bump-outs on W. Monte Vista Drive in connection with a proposed multi-family development. The two bump-outs were designed to accommodate a driveway entrance that was not developed, and apartment buildings were constructed over the two bump-outs. The property owner has asked the City to terminate the sidewalk easements over the two bump-outs.
STAFF ANALYSIS
Engineering staff determined sidewalks were not needed over the two bump-outs and approved the Partial Termination and Release of Easement over the two bump-outs. Accordingly, staff is recommending that Council approve the Partial Termination and Release the Easement, authorize its execution by the City Manager and recordation with the Maricopa County Recorder.
