RECOMMENDATION

Approve a 90-day extension of the Final Plat for La Privada Parcels 3 & 7 Phase 1 approved on January 23, 2023, subject to stipulations, which extension shall commence on August 10, 2024, the date of the current approval expiration. (Marty Crossland, Deputy Director of Development Engineering)

FISCAL IMPACT

Although a fiscal impact analysis has not been conducted on this specific project, all new development will have an ongoing fiscal impact on the City. The development is responsible for construction of all infrastructure necessary to serve the site and will generate one-time revenue for the City through payment of permits, construction sales tax and development impact fees. Longer term fiscal impacts include increased demands for municipal services, the costs of which may or may not be offset by increased property values/tax levies, city sales tax, state shared revenues and the increased demand for commercial and retail development. Any areas that will be maintained by the city are constructed by the developer and then conveyed to the city two years after construction.

BACKGROUND AND PREVIOUS ACTIONS

The Preliminary Plat of La Privada Parcels 3 & 7 was approved by the City Council on September 27, 2021. A Final Plat of La Privada Parcels 3 & 7 Phase 1 was approved by the City Council on January 23, 2023. A re-approval of the Final Plat was approved by City Council on February 12, 2024. An administrative 90-day extension was approved by staff on April 15, 2024.  The current extension expires on August 10, 2024.

The Final Plat of La Privada Parcels 3 & 7 Phase 1 has not been recorded because the property is being sold to a builder who will be developing the property.  Although the current owner of the property, Melcor Developments, Ltd., has been working diligently on the completion of the sale, the purchase and sale have not yet been finalized.  Melcor has requested the extension so the sale and purchase can be finalized, at which time the final plat will be recorded.  Melcor Developments Ltd is requesting a second 90-day extension.  The request for an extension to extend the approval was received prior to the current recording deadline as required by Section 15-2-5(I)(1) of the Goodyear City Code.

STAFF ANALYSIS

Under the Goodyear City Code, the approval of a final plat expires if the final plat is not recorded within 90-days of the date the final plat was approved unless the approval has been extended as provided in Goodyear City Code Section 15-2-5(I)(1).  The following conditions must be satisfied before an extension is granted: (a) there have been no substantive changes to any of the standards listed in subsection D of Section 15-2-5; (b) that the existing preliminary plat continues to comply with all applicable requirements; and (c) the subdivider has expended substantial effort and made substantial progress towards the completion of engineering construction plans for the required subdivision improvements.  Pursuant to the provisions in section 15-2-5(I)(1), the final plat approval was extended administratively for a period of 90 days. Section 15-2-5(I)(1) provides for a final plat approval to be extended for additional 90 days subject to City Council approval.

All conditions required for the requested extension have been satisfied.  Accordingly, Staff is recommending Council approve the requested 90-day extension.
