SUMMARY
A Map of Dedication to construct half-street improvements along the West Lower Buckeye Road and South 173rd Avenue project frontages of the La Jolla Vista subdivision.

RECOMMENDATION
Conditionally approve the Map of Dedication for La Jolla Vista, subject to stipulations. (Marty Crossland, Deputy Director of Development Engineering)
STIPULATIONS
1. This Map of Dedication (“MOD”) shall not be recorded until Roosevelt Irrigation District and Maricopa County have approved the construction plans for the infrastructure improvements to be constructed within the right of way being dedicated in this MOD for Lower Buckeye Road and 173rd Avenue; and
2. Prior to recordation of this MOD all technical corrections to this final plat required by the City Engineer or his designee shall be made; and
3. Prior to recordation of this MOD, Owner shall submit an updated title report for the property included within the boundaries of the MOD and shall modify the MOD to reflect the current ownership and current lender including on the final plat a Lender Consent and Subordination in a form approved by the City Attorney or his/her designee for all lenders with a security interest in the property included within the MOD. Owner shall provide documentation acceptable to the City Attorney or his/her designee demonstrating that the party executing the MOD is authorized to do so; and
4. Prior to recordation of this MOD, Owner shall the first paragraph of the Dedication Section to replace the reference to MAP OF DEDICATION FOR LA JOLLA VISTA – PHASE 1 with MAP OF DEDICATION FOR LA JOLLA VISTA.

FISCAL IMPACT
Although a fiscal impact analysis has not been conducted on this specific project, all new development will have an ongoing fiscal impact on the City. The development is responsible for construction of all infrastructure necessary to serve the site and will generate one-time revenue for the City through payment of permits, construction sales tax and development impact fees. Longer term fiscal impacts include increased demands for municipal services, the costs of which may or may not be offset by increased property values/tax levies, city sales tax, state shared revenues and the increased demand for commercial and retail development. Any areas that will be maintained by the city are constructed by the developer and then conveyed to the city two years after construction.
BACKGROUND AND PREVIOUS ACTIONS
On October 24, 2022, the City adopted Ordinance No. 2022-1545 and the associated Map 21-17 with Case Number 21-200-00017, to rezone the La Jolla Vista property from the previous PAD (Planned Area Development) zoning to the current R1-6 (Single-Family Detached) with PAD Overlay and R1-4 (Single-Family Detached) with PAD Overlay.
On February 3, 2023, staff administratively approved a Preliminary Plat for La Jolla Vista under Case Number 21-500-00014.

STAFF ANALYSIS
Ordinance No. 2022-1545 rezoning the property known as La Jolla Vista was subject to a number of stipulations/conditions of approval regarding infrastructure obligations. One of stipulation/conditions required Owner to complete full half-street improvements for the north-half of the section of W. Lower Buckeye Road between 173rd Avenue and Citrus Road required for a Minor Arterial except for the construction of one-half (½) the median and one-half (½) the median landscaping (the “Lower Buckeye Road Improvements”) before any Certificate of Completion, Temporary Certificate of Completion or Certificate of Occupancy for any structure within the zoned property except for model homes would be issued. Another required Owner to complete the full half-street improvements for the west-half of the section of S. 173rd Avenue from Lower Buckeye Road along or adjacent to the frontage of the property rezoned by Ordinance 2022-1545 required for a Major Collector and to construct a full median within 173rd Avenue from Lower Buckeye Road connecting into the existing median, which is approximately 100-feet north of the northern property line (the “173rd Avenue Improvements”) before any Certificate of Completion, Temporary Certificate of Completion or Certificate of Occupancy for any structure within the zoned property except for model homes would be issued. A final plat for Phase 1 of La Jolla Vista is being presented for Council approval at the meeting of July 8, 2024, under a separate Council Action Report, which triggers the obligation to construct the Lower Buckeye Road Improvements and the 173rd Avenue Improvements.
