SUBJECT: RESOLUTION ESTABLISHING A SPECIAL PUBLIC IMPROVEMENT PROJECT AREA AND AUTHORIZING COST RECOVERY FOR CIP PROJECT #42038 CAMELBACK ROAD WIDENING

SUMMARY

Adopt Resolution No. 2025-2494 for the formation of a Special Public Improvement Project Area authorizing the Cost Recovery for the Capital Improvement Program (CIP) Project #42038 Camelback Road Widening.

ADOPT RESOLUTION NO. 2025-2494 APPROVING AND ESTABLISHING A “SPECIAL PUBLIC IMPROVEMENT PROJECT AREA” THAT INCLUDES PROPERTIES RECEIVING SPECIAL BENEFITS FROM IMPROVEMENTS WIDENING CAMELBACK ROAD AND AUTHORIZING THE CITY TO RECOVER AN ALLOCATED SHARE OF THE COSTS OF THE SPECIAL PUBLIC IMPROVEMENTS FROM THE OWNERS OF THE BENEFITED PROPERTIES. (Steve Scinto, Director of Engineering; Allan Smolko, Senior Project Manager)

FISCAL IMPACT

The estimated total cost for the project’s cost-recovery impact on parcels, based on design, utility coordination, construction, right-of-way acquisition, and construction management, is $13,488,768.58. The city will seek reimbursements from the owners and developers of the properties benefiting from these improvements when the benefited properties develop. Opinion of Maximum Probable Construction Cost for the Benefited Properties, Exhibit 1 to the Resolution (Attachment A), provides a detailed account of the itemized cost on all the offsite infrastructure components.

BACKGROUND AND PREVIOUS ACTIONS

The 2014 Goodyear Transportation Master Plan (2014 TMP) recommended the widening of Camelback Road from State Route 303 (SR 303) to west of 152nd Avenue to accommodate anticipated future transportation demand. The 2014 TMP identified the segment of Camelback Road from Cotton Lane to Sarival Avenue as a demand-driven project needed by 2025, while the stretch from Sarival Avenue to 152nd Avenue was identified as long-range project to increase capacity for future demands.    

Staff later worked with a consultant to complete the Camelback Road Assessment Plan (Plan), which evaluated Camelback Road between SR 303 and Litchfield Road, with the intent to define levels of access needed to support development in a safe and efficient manner. Camelback Road is classified as a major arterial street, with three travel lanes in each direction, a center median, bike lanes, and sidewalks. The Plan provided a preliminary design and construction estimates for Camelback Road from SR 303 to 152nd Avenue in its ultimate major arterial configuration, as well as guidance regarding driveway locations, median breaks, and traffic signal locations in compliance city engineering standards.  The project was added to the fiscal year 2021-2026 Capital Improvement Program with design funding in fiscal year 2022 (CIP #42038 – Camelback Road – SR303 to 152nd Avenue).

On November 8, 2021, the Council adopted Resolution No. 2021-2183, approving an Intergovernmental Agreement with the Arizona Department of Transportation (ADOT) appropriating $8,000,000 to the city of Goodyear to be used towards the costs of widening Camelback Road from SR303 to Litchfield Road. Funds were utilized to design the entire Camelback Road corridor including sections within Goodyear, Glendale, Litchfield Park, and Maricopa County.

On May 23, 2022, the Council authorized the expenditure of funds up to $2,073,000 for design services for the Camelback Road - SR303 to 152nd Avenue (CIP #42038) project.

On September 18, 2023, staff presented an update on the Camelback Road - SR303 to 152nd Avenue widening project to the Council in a work session. At the meeting, staff recommended a reduction in the scope of the project to approximately 1.2 miles of half-street improvements located within Goodyear’s city limits and a change from a six-lane road design (three lanes / raised median / three lanes) to a four-lane road design (two lanes / center lane / two lanes). 

On December 18, 2023, the Council adopted Resolution No. 2023-2371, adopting the 2023 Goodyear Transportation Master Plan (2023 TMP). The 2023 TMP included the widening of Camelback Road between SR 303 and 152nd Avenue to a four-lane arterial street as a recommended project, with improvements to include bike lanes, curbs and gutters, sidewalks, traffic signals, and lighting. The south half of Camelback Road, which is located within the city of Goodyear, is a scalloped street in this segment of the road. Under the city’s development requirements, adjacent properties along Camelback Road would be required to complete full half-street improvements as those properties develop. The scalloped street condition exists as only certain properties along this section of Camelback Road between SR 303 and 152nd Avenue have developed.

STAFF ANALYSIS

Per city development requirements, the owners (or developers) of the properties adjacent to the section of Camelback Road between SR 303 and 152nd Avenue are responsible for constructing full half-street improvements that will be constructed as part of the Camelback Widening Project, the city’s construction of these improvements constitutes a benefit to which the owners have not contributed. Accordingly, staff is seeking to recover the costs of the improvements from the owners of the benefited properties. Resolution No. 2025-2494 would form the Special Public Improvement Project Area and allow for the city to recover the costs of the improvements benefiting the adjacent properties. The engineer’s estimate of the maximum probable cost for each of the benefited properties is set forth in Exhibit 1 of the resolution as reflected in Attachment A with Exhibits one, two, three, and four, but a summary of those costs is as follows:

The owners of the benefited properties were notified in writing of the efforts to seek cost recovery for the costs of the improvements that will benefit their respective properties, including the formation of a Special Public Improvement Project Area. The purpose of the public hearing is to allow the benefited property owners to raise any objections to the cost allocation methodology. When development proposals are submitted on these properties, the city will require reimbursement payment for their proportionate share of the cost of these improvements payable. Reimbursement is required prior to the recordation of the first final plat subdividing all or part of a benefited property or as a condition of approval of any site plan for the development of any portion of a benefited property. The city will be entitled to withhold construction permits until the required reimbursement has been made.

Staff recommends adopting Resolution No. 2025-2494, included as Attachment A, forming the Special Public Improvement Project Area and requiring the owners of the properties receiving special benefits from the construction of the improvements widening Camelback Road to reimburse the city for the costs of the improvements in an amount not to exceed the maximum probable costs set forth in the engineers' estimates attached to the resolution.
