SUMMARY
Transfer and annexation from Maricopa County to the city of Goodyear of approximately 1.501 acres of right-of-way generally located within the north half of the West Roosevelt Street alignment west of North Citrus Road, to facilitate construction of roadway improvements associated with the I-10 Citrus Gateway development.

RECOMMENDATION
ADOPT ORDINANCE NO. 2025-1640, APPROVING THE TRANSFER OF APPROXIMATELY 1.501 ACRES OF RIGHT-OF-WAY, GENERALLY LOCATED WITHIN THE NORTH HALF OF THE WEST ROOSEVELT STREET ALIGNMENT WEST OF NORTH CITRUS ROAD, APPROVING THE TRANSFER OF SUCH RIGHT-OF-WAY, AND EXTENDING AND INCREASING THE CORPORATE LIMITS OF THE CITY OF GOODYEAR. FISCAL IMPACT
There is no anticipated initial cost to the city for the annexation of right-of-way, as the developer of the adjacent I-10 Citrus Gateway project south of W. Roosevelt Street will be responsible for all annexation and roadway improvement expenses. However, the city will assume long-term maintenance obligations associated with expanding the city boundary to include the additional roadway and landscaped median.
Although a fiscal impact analysis has not been conducted on this specific project, all new development will have an ongoing fiscal impact on the city. The development is responsible for construction of all infrastructure necessary to serve the site and will generate one-time revenue for the city through payment of permits, construction sales tax and development impact fees. Longer term fiscal impacts include increased demands for municipal services, the costs of which may or may not be offset by increased property values/tax levies, city sales tax, state shared revenues and the increased demand for commercial and retail development. Any areas that will be maintained by the city are constructed by the developer and then conveyed to the city two years after construction.

BACKGROUND AND PREVIOUS ACTIONS
On April 28, 2025, Goodyear City Council adopted Ordinance No. 2025-1631, conditionally rezoning approximately 267 acres of property located at the southwest corner of North Citrus Road and West Roosevelt Street, to be known as I-10 Citrus Gateway, from the Las Palmas Planned Area Development (PAD) to the I-10 Citrus Gateway PAD.
A stipulated condition of approval for the I-10 Citrus Gateway zoning case required the applicant to process an annexation application, at no cost to the city, to bring the West Roosevelt Street right-of-way into the city of Goodyear. The annexation will enable construction of improvements to West Roosevelt Street that will create a new roadway alignment that separates traffic generated by the I-10 Citrus Gateway development from existing local traffic. The developer will construct West Roosevelt Street and a median within the city’s corporate limits and modify the county-maintained frontage road to the north of West Roosevelt Street which will function as a local street serving county residents to access the residential properties north of the I-10 Citrus Gateway development. West Roosevelt Street and the frontage road will be separated by a median with landscaping.

Current Policy:
Pursuant to A.R.S. § 9-471(O), a county right-of-way or roadway may be transferred to an adjacent city by mutual consent of the governing bodies of both the county and city if all of the property transferred is adjacent to the receiving city and if the city and county each approve the proposed transfer as a published agenda item at a regular public meeting of their governing bodies. Unlike annexations, a transfer does not include a petition for signatures or public hearings. A transfer of property made pursuant to this subsection is treated by the receiving city as if the transferred property was newly annexed territory.
The transfer of the right-of-way is approved by the Goodyear City Council by Ordinance (Attachment A), and subsequently sent to Maricopa County. The transfer of the right-of-way must be approved by the Maricopa County Board of Supervisors and after both governing bodies approve the transfer, the right-of-way is treated the same as any other newly annexed land.
Upon approval of the transfer by both the city and the Maricopa County Board of Supervisors according to the procedures in A.R.S. § 9-471(O), the city of Goodyear will be responsible for the maintenance of the transferred right-of-way.
Surrounding Properties:
The portion of West Roosevelt Street right-of-way that will be transferred is fifteen (15) feet in width and runs east to west from North Citrus Road to approximately 900 feet east of South Perryville Road.
To the south of the right-of-way is the I-10 Citrus Gateway Planned Area Development, which anticipates Industrial, Business Park and Commercial Uses. To the north of the right-of-way are rural residential properties within Maricopa County zoned RU-43.
Details of the Request:
The annexation of this right-of-way is being pursued to transfer ownership of the right-of-way from Maricopa County to the city of Goodyear to facilitate permitting and construction of roadway improvements and provide access to the I-10 Citrus Gateway development to the south.
Once annexed, the transferred right-of-way will be under the city of Goodyear’s authority, and all construction permits will be reviewed and issued by the city.
