SUBJECT: RESOLUTION AUTHORIZING ACQUISITIONS OF REAL AND PERSONAL PROPERTY INTERESTS NEEDED FOR THE ESTRELLA PARKWAY AND SPRING DRIVE TRAFFIC SIGNAL IMPROVEMENTS PROJECT (CIP #42101)

SUMMARY

Approval of this item will authorize the acquisition of land rights (temporary construction access easements) within the project corridor necessary for the completion of the Estrella Parkway and Spring Drive Traffic Signal Improvements project (CIP #42101).

FISCAL IMPACT

This project (CIP #42101) is included in the city's fiscal year FY2026 capital improvement program budget. The budget for the land component is $50,000.00 and will be used to pay compensation for (i) the three temporary construction and access easements required for the project; (ii) payment for personal property improvements that may be impacted by the project; (iii) payment of cost to cure; and (iv) transaction-related cost such as title reports, appraisals, appraisal reviews, escrow closing cost, partial release fees, right of entry, title insurance and legal fees of outside counsel and litigation guarantee reports, if eminent domain is required.
 

BACKGROUND AND PREVIOUS ACTIONS

At the June 9, 2025 Regular Meeting, Council approved the Estrella Parkway and Spring Drive Traffic Signal Improvements (CIP #42101) project in the adoption of Resolution No. 2025-2475 Determining and Adopting the Final Estimates of Proposed Revenues and Expenditures by the City of Goodyear for FY2026.
 

STAFF ANALYSIS

The project will enhance the intersection by installing ADOT-standard traffic signals, and includes new Intelligent Transportation Systems (ITS) infrastructure, including the installation of a fiber segment that will connect to existing city fiber and close a gap in the city’s network.

The project also includes improvements to the existing ramps at all corners of the intersection and related features to ensure compliance with the Americans with Disabilities Act (ADA).
The project impacts three parcels located at the project intersection. A depiction of the three impacted parcels is provided in the Right-of-Way Strip Map attached as Exhibit “A” to Resolution No. 2026-2513 (Attachment A).

Based on the current design, the city will need to acquire Temporary Construction Easements (TCEs) from the property owners of the properties on three of the four intersection corners as depicted in the Right-of-Way Strip Map. The TCEs are necessary to accommodate construction activities, including providing access to the right-of-way within which the traffic signal improvements will be installed, the placement and operation of specialized equipment required for underground utility installation (e.g., directional boring equipment), as well as construction access and staging. These activities cannot be performed entirely within the existing right-of-way due to equipment footprint and operational safety requirements. The foregoing activities will impact personal property within the easements being acquired, including the removal of certain personal property. 

The easements will be temporary in nature, and property owners will be compensated for the easements and the damage and/or removal of personal property located within the easements being acquired in accordance with applicable acquisition policies and state law.

Staff recommends Council adopt Resolution No. 2026-2513 authorizing and directing city staff to acquire, by dedication, donation, purchase, or the exercise of the power of eminent domain, the real and personal property interests needed for the completion of the project from the owners of the properties identified on the Right-of-Way Strip Map.
