SUBJECT: RESOLUTION APPROVING AN INTERGOVERNMENTAL AGREEMENT (IGA) WITH ARIZONA DEPARTMENT OF TRANSPORTATION (ADOT) FOR CIP PROJECT #50059 BULLARD WASH TRAIL

SUMMARY

Intergovernmental Agreement (IGA) with the Arizona Department of Transportation (ADOT) regarding development and maintenance of Bullard Wash Trail within ADOT right-of-way for CIP Project #50059.

RECOMMENDATION

ADOPT RESOLUTION NO. 2026-2523 APPROVING AN INTERGOVERNMENTAL AGREEMENT WITH THE STATE OF ARIZONA REGARDING THE DEVELOPMENT AND MAINTENANCE OF A SECTION OF THE BULLARD WASH TRAIL WITHIN ARIZONA DEPARTMENT OF TRANSPORTATION RIGHT OF WAY. FISCAL IMPACT

Funding for CIP Project #50059 – Bullard Wash Trail is included in the City’s Fiscal Year (FY) 2027 adopted Capital Improvement Program. The total estimated project cost is approximately $32.27 million, funded through a combination of General Obligation bonds and one-time General Fund.

The IGA does not include any direct financial participation from ADOT. The city of Goodyear is responsible for all costs associated with design, construction, and ongoing operation and maintenance of the shared use pathway within the ADOT right-of-way.

Parks and Recreation has developed an operations and maintenance budget for Bullard Wash beginning in FY2028, which includes maintenance associated with this segment of the project.

BACKGROUND AND PREVIOUS ACTIONS

At the November 13, 2023, Regular Council Meeting, the Goodyear City Council adopted the Parks and Recreation Master Plan with the adoption of Resolution No. 2023-2366, which identifies the Bullard Wash Trail as a key component of the city’s planned trail network.

At the June 10, 2024, Regular Council Meeting, the Goodyear City Council approved CIP Project #50059 which includes improvements along the Bullard Wash corridor between McDowell Road and the Ballpark to enhance regional connectivity and expand the city’s trail system.

On June 9, 2025, City Council approved the FY26 budget, which included CIP Project #50059. 

STAFF ANALYSIS

The Bullard Wash Trail is a planned multi-use pathway that provides a key north-south connection through the city, linking McDowell Road to Estrella Mountain Regional Park and connecting major destinations such as the Goodyear Ballpark and GSQ. The project is identified in the City’s Parks and Recreation Master Plan and supports the development of an off-street pathway system with grade-separated crossings to enhance pedestrian and bicycle connectivity.

Through coordination with ADOT, it has been determined that an IGA between the city of Goodyear and ADOT is required to allow for the construction, operation, and ongoing maintenance of the shared use pathway within ADOT right-of-way.


This IGA sets forth ADOT’s requirements for allowing the city to construct, operate, and maintain the shared use pathway within ADOT right-of-way.
Under the terms of the IGA, the city is responsible for:
  • all costs associated with the design, construction, and maintenance of the improvements being constructed within ADOT's right-of-way (the "Project Area"), which improvements are subject to the approval of ADOT;
  • obtaining all required permits from the State for the construction of the improvements within the Project Area;
  • obtaining annual permits from the State for the maintenance of the improvements within the Project Area;
  • maintaining and repairing the improvements constructed within the Project Area;
  • removing and cleaning up homeless encampments that may be located within the Project Area; and
  • providing ADOT access to the Project Area as needed for ADOT to maintain its infrastructure.
The IGA provides for ADOT's retention of "prior rights" to the right-of-way, which gives ADOT the right to make any modifications within the Project Area, including the removal or alteration of the city's improvements therein, if required for transportation purposes without compensation to the city. In addition, under the terms of the IGA, ADOT is not responsible for damages to the city's improvements within the Project Area caused by ADOT's maintenance of ADOT's infrastructure. 

Staff recommends adopting Resolution No. 2026-2523 (Attachment A) and supports approval of the IGA, as it is necessary for the project to move forward and will facilitate the development of a critical segment of the city’s trail network.
