SUBJECT: RESOLUTION ESTABLISHING A SPECIAL PUBLIC IMPROVEMENT PROJECT AREA AND AUTHORIZING COST RECOVERY FOR CIP PROJECT #42046 COTTON LANE: ESTRELLA PARKWAY TO COTTON LANE BRIDGE

SUMMARY

Adopt Resolution No. 2026-2530 for the formation of a Special Public Improvement Project Area authorizing the Cost Recovery for the Capital Improvement Program (CIP) Project #42046 Cotton Lane: Estrella Parkway to Cotton Lane Bridge.

RECOMMENDATION

Adopt Resolution No. 2026-2530 ​approving and establishing a “Special Public Improvement Project Area” that includes properties receiving special benefits from improvements widening Cotton Lane and authorizing the City to recover an allocated share of the costs of the special public improvements from the owners of the benefited properties​. (Logan Hopp, Deputy Director of Engineering) 

FISCAL IMPACT

The estimated total cost of the project improvements for the Cotton Lane widening project is $13,861,466.50.  Certain portions of the project improvements, estimated to cost $9,539.352.17, will specifically benefit thirteen properties. The remainder of the costs are for improvements that provide a general benefit to the public. The proposed resolution will allow the city to seek reimbursement from the owners and developers of the properties specifically benefiting from these improvements at the time the benefited properties develop.

BACKGROUND AND PREVIOUS ACTIONS

The Estrella communities south of the Gila River are experiencing growth consistent with the growth seen throughout the city. Cotton Lane crosses the Gila River approximately two miles west of the Estrella Parkway Bridge. The Cotton Lane Bridge, constructed in 2007, was built to accommodate six lanes; however, it is currently striped and configured for four lanes of traffic (two lanes of travel in each direction) with a wide center median. South of the Cotton Lane Bridge, Cotton Lane currently only has two travel lanes (one northbound lane and one southbound lane) to its intersection with Estrella Parkway.  This segment of Cotton Lane's was installed as an interim condition. 
  
The widening of Cotton Lane between Estrella Parkway and approximately 700 feet south of the Gila River is identified in the City’s 2023 Transportation Master Plan (TMP). The city's CIP project advances completion of Cotton Lane as a divided arterial between Estrella Parkway and the Gila River bridge. The project scope includes rehabilitation and widening of Cotton Lane to four lanes, improving long-term capacity and overall corridor performance. The project represents a strategic near-term investment in mobility and multimodal connectivity. 

The project was added to the Fiscal Year (FY) 2023–2027 Capital Improvement Program with design funding programmed in FY2023 (CIP #42046 – Cotton Lane – Estrella Parkway to Cotton Lane Bridge). 

At the June 6, 2022 Special Meeting, Council adopted Resolution No. 2022-2253, which authorized the expenditure of funds up to $806,200 for design services for the Cotton Lane Widening – Estrella Parkway to Cotton Lane Bridge (CIP #42046) project. 

At the December 18, 2023 Regular Meeting, Council adopted Resolution No. 2023-2371, approving the 2023 Goodyear Transportation Master Plan, which includes the widening of Cotton Lane between Estrella Parkway and the Gila River Bridge. 

At the June 9, 2025 Special Meeting, Council adopted Resolution No. 2025-2475, which authorized the expenditure of funds up to $20,912,200 for design and construction of the Cotton Lane Widening – Estrella Parkway to Cotton Lane Bridge (CIP #42046) project. 

STAFF ANALYSIS

Pursuant to city development requirements, the owners (or developers) of properties adjacent to the section of Cotton Lane between Estrella Parkway and the Gila River Bridge are responsible for constructing full half-street improvements. These improvements are being constructed as part of the city's CIP Cotton Lane widening project; therefore, the city’s construction of these improvements confers a special benefit upon the adjacent properties for which the owners have not yet contributed. Accordingly, staff is seeking to recover the proportionate cost of these improvements from the owners of the benefited properties. 

Resolution No. 2026-2530 would establish the Special Public Improvement Project Area and authorize the city to recover the costs of the improvements benefiting the adjacent properties. 

The engineer’s estimate of the maximum probable cost allocated to each benefited property is set forth in Exhibit 1 of the resolution as reflected in Attachment A with Exhibits 1-4. A summary of the allocated costs is provided below:

The owners of the benefited properties were notified in writing of the city’s intent to seek cost recovery for the improvements benefiting their respective properties, including the formation of a Special Public Improvement Project Area. The purpose of the public hearing is to provide the benefited property owners an opportunity to raise any objections to the cost allocation methodology. Upon submittal of development proposals for these properties, the city will require reimbursement of the proportionate share of the improvement costs. Reimbursement will be required prior to the recordation of the first final plat subdividing all or any portion of a benefited property, or as a condition of approval of any site plan for development of any portion of a benefited property. The city may withhold construction permits until the required reimbursement has been paid. 

Staff recommends adopting Resolution No. 2026-2530, included as Attachment A, establishing the Special Public Improvement Project Area and requiring the owners of properties receiving special benefits from the Cotton Lane widening improvements to reimburse the city for their proportionate share of the costs, in an amount not to exceed the maximum probable costs set forth in the engineer’s estimates attached to the resolution.
