| SUBJECT: | AMEND CONDITIONS OF APPROVAL OF THE FINAL PLAT OF SEDELLA PARCEL 2A |

SUMMARY:
A request has been made to amend the conditions of approval of the Final Plat of Sedella Parcel 2A to allow for the continued development of the development known as Sedella while issues are worked out with Maricopa County Water District (MWD) regarding the easements and right of way needed for the construction of road improvements that require the relocation of MWD infrastructure.
Recommendation:
Amend the conditions of the April 13, 2020 approval of the Final Plat of Sedella Parcel 2A, to delete stipulation 8 and add two stipulations. (Stephen Scinto, Deputy Director Engineering)
STIPULATIONS:
Stipulation 8 of the April 13, 2020 approval of the Final Plat of Parcel 2A is hereby deleted
The following two stipulations are added as conditions of approval of the Final Plat of Sedella Parcel 2A

- No more than 45 single family building permits within Sedella Parcel 2A (approximately 75% of Sedella Parcel 2A) shall be issued until the city has received, at no cost to the city, in fee, lien free and free of any easement not specifically approved by the city, the property at the northeast corner of West Camelback Road and North Citrus Road identified on page 5 of the Final Plat for Sedella Parcel 2A as MWD Well Site 13-22 (50x50) and Well, Book 331, Pages 102-104 (the Existing MWD Well Site”)
- No more than 54 single family building permits within Sedella Parcel 2A (approximately 90% of Sedella Parcel 2A) shall be issued until City has received all necessary easements and rights-of-way needed for the construction of the improvements on the approved improvement plans for the intersection of Camelback Road and Citrus Road
FISCAL IMPACT:
There is no anticipated fiscal impact to the City, as a result of the proposed modifications to the Final Plat stipulations.
BACKGROUND AND PREVIOUS ACTIONS:
- The Sedella Planned Area Development (PAD) was approved by the City Council on June 13, 2005, with the adoption of Ordinance No. 05-946
- The preliminary plat for Sedella was approved by the City Council on June 13, 2005.
- The final plat for Sedella Parcel 2A was approved by the City Council on April 13, 2020.
STAFF ANALYSIS
The construction of improvements to Camelback Road is required as a condition of the development of Sedella. The construction of these road improvements requires the relocation of existing MWD improvements and the conveyance to MWD of easements and/or real property for the relocated facilities. The city is required to acquire any off-site property and/or easements as needed for relocated MWD facilities.
City staff and the developer have been coordinating with MWD. Although construction plans have been approved, MWD has yet to finalize the legal descriptions for the property and/or easements needed for the relocated MWD facilities. The delay in getting approved legal descriptions has delayed the acquisition of the required property and/or easements and the completion of the Camelback Road improvements.
A request has been made to amend the conditions of approval of the Final Plat of Sedella Parcel 2A to allow for the continued development of residential lots within Sedella while issues are worked out with MWD regarding the easements and right of way needed for the relocated MWD facilities. The proposed modifications to stipulations allow for additional flexibility in developing the subdivision lots while the developer and City staff work through the acquisition of off-site easements and ROW, while ensuring there are final “milestones” that must be hit prior to buildout of Sedella Parcel 2A.
