SUMMARY
Declaration of easements for city owned utilities located within city owned property.
Recommendation
ADOPT RESOLUTION NO. 2021-2186 DECLARING EXCLUSIVE UTILITY EASEMENTS, PROVIDING DIRECTION REGARDING THE RECORDATION OF THE RESOLUTION AND PROVIDING FOR AN EFFECTIVE DATE. (Linda Beals, Real Estate Coordinator)
FISCAL IMPACT
There will be no fiscal impact to the city in the fiscal year 2022 or future years related to the acceptance of this easement.
BACKGROUND AND PREVIOUS ACTIONS
The city owns several parcels of land which were acquired as part of the city’s Bullard Wash storm water system and future linear park alignment between Van Buren Street and MC-85 (“City Property”). The city is currently in the final design phase of drilling for a new city well (Well 26) and the associated water line which will transport the water from the new Well 26 to the existing city water treatment facility located on Bullard Avenue south of Yuma Road. The water line will be located within a portion of the City Property and will be constructed parallel to an existing sewer line that was previously constructed within the City Property.
STAFF ANALYSIS
In order to provide notice of the existence of these lines, staff is recommending that Council declare exclusive utility easements for the city utilities in the locations where the sewer lines and water lines are located, or will be located, and have the Resolution recorded with the Maricopa County Recorder’s Office for future reference.
