SUMMARY
The applicant is requesting a recommendation of approval for a new Series 12 (Restaurant) liquor license.
Recommendation
Recommend approval to the Arizona Department of Liquor Licenses and Control (DLLC) of Application No.167964, a request by Amy S. Nations, agent/applicant for Tomo Japanese Cuisine, for a new Series 12 liquor license. Tomo Japanese Cuisine is located at 1550 N. Dysart Road #A7, A8, and A9, Goodyear, Arizona 85338 (generally located near the southwest corner of Dysart Road and McDowell Road). (Darcie McCracken, City Clerk)
FISCAL IMPACT
The applicant paid the $635 application fee for the liquor license per the Goodyear Municipal User Fee Schedule. The business will also contribute to the tax base of the community.
BACKGROUND AND PREVIOUS ACTIONS
Ms. Nations has applied for a new Series 12 liquor license for Tomo Japanese Cuisine, which is currently open for business and operating under an Interim Permit issued by the Arizona Department of Liquor Licenses and Control (DLLC). An Interim Permit allows an applicant to sell, serve and store liquor under an existing license of the same series at the same location while their new license is processed (A.R.S. § 4-203.01).
The City Clerk's Office received the application from the DLLC on November 5, 2021. The applicant paid the $635 application fee for the liquor license, and a public notice was posted on the property on November 19, 2021, to comply with the State-mandated 20-day comment period. No petitions or protests from qualified persons were received during the comment period.
The application was routed to the Police Department and the Development Services Department (Planning and Zoning, Code Compliance and Building Safety), and any comments are listed below:

STAFF ANALYSIS
A Series 12 license is for a restaurant and is non-transferrable. This on-sale retail privileges liquor license allows the holder to sell and serve all types of spirituous liquor solely for consumption on the premises of an establishment which derives at least forty percent (40%) of its gross revenue from the sale of food.
The DLLC requires license owners, agents, and managers actively involved in the day-to-day operations of the business to complete a state approved management training course prior to the issuance of a liquor license. The state-training has already been scheduled and will be completed by Manger, Gyeyoon Joo before December 10, 2021. In addition to completing the required training, the manager will be on site during all business hours. Restaurant workers will be checking state identification cards and driver licenses to all when serving alcohol.
There are no licensed childcare facilities, K-12 schools or churches within 300 feet of the location.
