SUMMARY
Acceptance of a Water Line and Access Facilities Easement from OZB BG HARVARD, LP, an Arizona limited partnership for the REV at Ballpark Village Development located south of Lower Buckeye Parkway on the west side of Estrella Parkway.
Recommendation
Accept the Water Line and Access Facilities Easement from OZB BG HARVARD, LP, an Arizona limited partnership. (Linda Beals, Real Estate Coordinator)
FISCAL IMPACT
There will be no fiscal impact to the City in the fiscal year 2022 of future years associated with the acceptance of this easement.
BACKGROUND AND PREVIOUS ACTIONS
A Replat of Ballpark Village Lot 32B was approved by Council on March 22, 2021 and was recorded in the official records of Maricopa County at Book 1581 Page 232 on March 25, 2021. The replat created 2 lots, one of which is Lot 32B1. Lot 32B1 is a 25.69 acre lot located south of Lower Buckeye Parkway on the west side of Estrella Parkway. This property is currently owned by OZB BG HARVARD, LP, an Arizona limited partnership (“OZB”) and they are in the process of developing a single-family residential development known as REV at Ballpark Village.
OZB is responsible for the design and construction of the water line which will serve the REV at Ballpark Village development. OZB has provided a Water Line and Access Facilities Easement needed for the water line it is to install.

STAFF ANALYSIS
The construction of this water line is needed as part of the construction of the REV at Ballpark Village development. The City has reviewed the construction plans and has required the dedication of the Water Line and Access Facilities Easement as part of the construction permitting process.
