| SUBJECT: | MAP OF DEDICATION FOR COMPASS DATACENTERS YUMA ROAD |

SUMMARY
A map of dedication to dedicate 0.84 acres of right-of-way adjacent to the northern edge of existing Yuma Road right-of-way, west of Bullard Avenue, in order to support the width needed for street improvements constructed to meet the ultimate development requirements.

RECOMMENDATION
Approve the Map of Dedication for Yuma Road, subject to stipulations. (Marty Crossland, Interim Deputy Director of Development Engineering)
STIPULATIONS
1. Any technical corrections to this final plat required by the City Engineer or his designee shall be made prior to the recordation of the MOD; and
2. Prior to recordation of the MOD, Owner shall submit a current title report for the property and shall modify this plat to reflect the current ownership and current lender, including on the map of dedication a Lender Consent and Subordination in a form approved by the City Attorney or his/her designee for all lenders with a security interest in the Property being platted herein. Owner shall provide documentation acceptable to the City Attorney or his/her designee demonstrating that the persons executing this final plat are authorized to do so; and
3. Prior to the recordation of this MOD, all civil construction plans for the portion of Yuma Road being dedicated to the City in this MOD shall be approved by the City Engineer or his/her designee; and
4. Yuma Road Median Improvements. Owner shall not construct or install median improvements or landscaping within the median as part of the Yuma Road Improvements, but shall instead make an In-Lieu Payment to the City in the amount of $158,756.00 for one-half (1/2) of the cost of the full median and full median landscaping. The In-Lieu Payment referred to herein shall be paid prior to the issuance of the first civil construction permit for the construction of all or part of the Yuma Road Improvements; and

FISCAL IMPACT
Although a fiscal impact analysis has not been conducted on this specific project, all new development will have an ongoing fiscal impact on the City. The development is responsible for construction of all infrastructure necessary to serve the site and will generate one-time revenue for the City through payment of permits, construction sales tax and development impact fees. Longer term fiscal impacts include increased demands for municipal services, the costs of which may or may not be offset by increased property values/tax levies, city sales tax, state shared revenues and the increased demand for commercial and retail development. Any areas that will be maintained by the city are constructed by the developer and then conveyed to the city two years after construction.

· Final Plat of Compass Datacenters-PHX1 was recorded on 8/8/2019 Book 1476 Page 49.
· Minor Land Division of Parcel 1 Compass Datacenters-PHX1 was recorded on 10/19/2021 Book 1625 Page 19.
· The Compass Datacenters site plan amendment for BLDG 2 was approved by the Development Review Committee on September 14, 2022; site plan amendment for PH 3 – 6 was approved by the Development Review Committee on April 17, 2023;
· Civil engineering construction documents for Compass Datacenters Yuma Rd (22-5531) are currently under review by city staff.
· Minor Land Division of Parcel 1 Compass Datacenters-PHX1 was recorded on 10/19/2021 Book 1625 Page 19.
· The Compass Datacenters site plan amendment for BLDG 2 was approved by the Development Review Committee on September 14, 2022; site plan amendment for PH 3 – 6 was approved by the Development Review Committee on April 17, 2023;

STAFF ANALYSIS
The right-of-way width and road alignment established with this map of dedication (MOD) is consistent with the city of Goodyear Transportation Master Plan. The approval of this MOD will provide the necessary city right-of-way width in which Project Hustle can construct the offsite infrastructure improvements required by the project.
