SUMMARY

The applicant is requesting a recommendation of approval for a new Series 12 (Restaurant) liquor license.

RECOMMENDATION

Recommend approval to the Arizona Department of Liquor Licenses and Control (DLLC) of Application No. 236460, a request by Juanita Alicia Esparza, agent for Waffletto Coffee & Waffles for a new Series 12 liquor License. Waffletto Coffee & Waffles is located at 406 N. Litchfield Rd. #208, Goodyear, AZ 85338 (generally located N of Van Buren and W of Litchfield Rd.). (Darcie McCracken, City Clerk)

FISCAL IMPACT

The applicant paid the $635 application fee for the liquor license per the Goodyear Municipal User Fee Schedule. The business will also contribute to the tax base of the community.

BACKGROUND AND PREVIOUS ACTIONS

Ms. Esparza has applied for a new Series 12 liquor license for Waffletto Coffee & Waffles which is currently open for business.

The City Clerk's office received the application from the DLLC on May 15, 2023. A Public Notice was posted on the property on the same day, May 15, 2023, to comply with Arizona Revised Statues §4-201(b). No Petitions or protests from qualified person were received during the comment period.

The application was routed to the Police Department and the Development Services Department (Planning & Zoning, and Building Safety), and any comments from these departments are listed below:

STAFF ANALYSIS

A Series 12 liquor license is for a restaurant and is non-transferable. This on-sale retail privileges liquor license allows the holder to sell all types of spirituous liquor solely for consumption on the premises of an establishment that derives at least forty percent (40%) of its gross revenue from the sale of food.

The DLLC requires liquor license owners, agents, and managers actively involved in the day-to-day operations of the business to complete a state-approved management training course prior to the issuance of a liquor license. The registered premise manager will complete the proper training and all employees will be educated in the Title 4 liquor law training. Restaurant workers will require proper identification from anyone ordering alcohol.

There are no licensed childcare facilities or K-12 schools within 300 feet of the location. The City Council's recommendation of "Approval", "Disapproval", or "No Recommendation" will be forwarded to the DLLC for consideration during their licensing review process.
