SUMMARY
Approval of acceptance of right-of-way required for improvements to the Bullard Avenue Widening @ Southbound Van Buren project will allow right of way clearance for the project.

RECOMMENDATION
Authorize the acceptance and execution of Special Warranty Deed from Squaw Peak Goodyear LLC, an Arizona limited liability company conveying right-of-way to the City. (Kimberly Romero, Real Estate Coordinator)
FISCAL IMPACT
Although a fiscal impact analysis has not been conducted on the dedication provided for herein, the conveyance is required per the zoning stipulations.
BACKGROUND AND PREVIOUS ACTIONS
On February 11, 2019, the City Council adopted Ordinance 2019-1422, re-zoning approximately 95 acres of land located at the southwest corner of Bullard Avenue and Van Buren Street, from the AU (Agricultural Urban) zoning district to the I-1 (Light Industrial Park), C-2 (General Commercial), and MF-24 (Multi-Family) zoning districts with a PAD overlay, amending the zoning map of the City of Goodyear; providing for an effective date; and providing for penalties. The property is known as Goodyear Airport Commons. Pursuant to Section 3 Stipulations item number 15 of Ordinance 2019-1422, the Owner of the portions of the Goodyear Airport Commons Property along the frontage of Bullard Avenue is required to dedicate to the city, in fee, an additional 32-fee of right-of-way along such frontage prior to the issuance of the first civil construct permit within such portion of the Property or when requested by the City Engineer, whichever is earlier”.
Most of the Goodyear Airport Commons Property adjacent to the frontage of Bullard Avenue has been developed and the owner(s) of such property have dedicated the required right-of-way and have improved the sections of Bullard Avenue adjacent to their property. However, there is a section of the Goodyear Airport Commons Property with frontage along Bullard Avenue that has not been developed. The city is undertaking the Bullard Avenue Widening Project to complete the improvements to Bullard Avenue along the undeveloped section of the Goodyear Airport Commons Property and requires the additional right-of-way needed to complete such improvements.
STAFF ANALYSIS
The owner has agreed to convey the right-of-way to the city, in the forms attached hereto. The council is required to accept the conveyance of street right-of-way. Normally staff would not seek acceptance until fully executed documents have been received. However, so as not to delay the Bullard Avenue Widening project, staff is asking Council to authorize the acceptance of the right-of-way from Squaw Peak Goodyear LLC following the city’s receipt of executed special warranty deeds.
