RECOMMENDATION
ADOPT RESOLUTION NO. 2023-2325 DECLARING AS PUBLIC RIGHT-OF-WAY CITY-OWNED PROPERTY LOCATED WITHIN A SECTION OF THE SOUTH 173rd AVENUE ALIGNMENT; REQUIRING RECORDATION; AND PROVIDING FOR AN EFFECTIVE DATE .
FISCAL IMPACT
There is no fiscal impact to the City for declaring a portion of its property as public right-of-way for FY24 or future years.
BACKGROUND AND PREVIOUS ACTIONS
City of Goodyear owns 5.74 acres of land (current parcel number 502-43-028M) currently used for the City of Goodyear Well 12 Tank and Booster Station. The owner/developer of Artesian Casitas is improving a section of the west-half of 173rd Avenue, the improvements include the construction of additional pavement, curb, gutter, sidewalk, drainage improvements, and pedestrian ramps. The construction of these improvements requires additional right-of-way from the owner of the Artesian Casitas and from the City.
STAFF ANALYSIS
Staff recommends the approval of Resolution 2023-2325 as it will allow for the completion of a section of 173rd Avenue, including improvements within the city-owned property that the city would otherwise have to construct.
