SUMMARY
The city is being asked to grant an access easement over a portion of city owned property to provide secondary access to a property being developed under the name Artesian Casitas at West Goodyear.

RECOMMENDATION
Approve the Artesian Casitas Access Easement between 29SC Cotton Property owner, LLC and the City of Goodyear granting an Easement over a portion of city owned property at the intersection of W. Kendall Street and South 173rd Avenue. (Kevin Spicer, RWA-GN, Real Estate Specialist)
FISCAL IMPACT
No fiscal analysis has been prepared for the impact of the granting of the easement, but any impact to the City for encumbering its property will be de minimis because of location of the easement and the configuration of the city’s parcel.
BACKGROUND AND PREVIOUS ACTIONS
City of Goodyear owns 5.74 acres of land (502-43-028M) currently used for the City of Goodyear Well 12 Tank and Booster Station (the “City Parcel”). The property along the western boundary of the City Parcel is being developed under the name of Artesian Casitas at West Goodyear. The city’s development standards required a secondary point of access into the Artesian Casita development. The property owner has requested an access easement from the city over approximately 1,635 square feet of the City Parcel to allow the Artesian Casita development to be accessed at the intersection of 173rd Avenue and W. Kendall Street.
The location of the access easement is outside the fence of the water facilities constructed within the City Parcel and staff with the city’s utilities department have advised the granting of the easement will not conflict with its operations or needs with regards to the City Property. Moreover, because of the configuration of the City Parcel, the city cannot put the area in which the access easement is located to any other beneficial use. As part of the Artesian Casitas development, the owner/developer, at no cost to the city, will be constructing improvements to 173rd Avenue, including the installation of sidewalk improvements to the section of 173rd Avenue along the frontage of the City Parcel.

STAFF ANALYSIS
Staff is recommending granting an Access Easement to 29SC COTTON PROPERTY OWNER, LLC over a portion of the City Parcel. The granting of the easement will not impact the operations of the water facilities, and because of the location of the easement, the impact on the value of the City Parcel is de minimis. The grant of this easement will facilitate the development of Artesian Casitas at West Goodyear and the owner/developer of Artesian Casitas, at their sole cost and expense, will be installing infrastructure improvements along the section of 173rd Avenue adjacent to the City Parcel, which the city would otherwise have to install.
