Approval of five separate Termination and Release of Temporary Drainage Easement terminating five temporary drainage easements no longer needed by the City as the property has been developed and permanent drainage facilities are in place.

Approve and authorize the City Manager to execute five Termination and Release of Temporary Drainage Easement, terminating five (5) existing temporary drainage easements no longer needed and authorize the City Manager to execute the release and the City Clerk to record the release with the Maricopa County Recorder. There is no fiscal impact to the city related to the release of the existing temporary drainage easements.

On April 16, 2009, the City accepted five (5) non-exclusive and temporary drainage easements from Sun MP Investment Properties, LLC (the Drainage Easements).  The Drainage Easements were provided to accept and retain storm drainage from Bullard and Yuma roads and maintain on-site drainage prior to the development of the adjacent property.

City engineering staff recently received a request from the current property owners of the Airpark Logistics Center asking the City to terminate the five temporary drainage easements that had been previously conveyed to the City. The Drainage Easements require the city to record separate instruments terminating the Drainage Easements upon the development of the adjacent property consistent with the City approved development plans that incorporated the drainage flows that were being retained in the Drainage Easements. City engineering staff have reviewed the information provided and confirmed the Drainage Easements are no longer needed because permanent on-site drainage has been facilitated and approved.
