SUMMARY
A Final Plat for subdividing approximately 40 acres into 40 lots and 14 tracts south of Elliot Road and ½ mile west of San Miguel Drive .

RECOMMENDATION
Approve the Final Plat for Arroyo Ranch, subject to stipulations. (Marty Crossland, Deputy Director of Development Engineering)
STIPULATIONS
1. Any technical corrections to this final plat required by the City Engineer or his designee shall be made prior to the recordation of the Final Plat; and
2. Prior to recordation of the final plat, Owner shall submit a current title report for the Property and shall modify this plat to reflect the current ownership and current lender including on the final plat a Lender Consent and Subordination in a form approved by the City Attorney or his/her designee for all lenders with a security interest in the property being platted herein. Owner shall provide documentation acceptable to the City Attorney or his/her designee demonstrating that the party executing this final plat is authorized to do so; and
3. Owner shall construct all on-site and off-site infrastructure improvements required: (i) for the City to provide utility services to the Property; (ii) by applicable Development Regulations, including by way of example, stipulations/conditions of approval of ordinances zoning the Property; the City of Goodyear subdivision regulations, the City of Goodyear Engineering Design Standards and Policies, and all adopted Building codes; and
4. Owner shall dedicate or cause the dedication, at no cost to the City, all easements and right-of-way needed for construction of all on-site and/or offsite infrastructure Owner is required to construct pursuant to stipulation 3 above. The conveyances required herein shall be lien free and free of all encumbrances except as agreed to by the City Engineer or his designee; and
5. Owner shall be responsible for installing and maintaining landscaping in the median and along the entrance road from south right-of-way line of Elliot Road to the north property line of the development, which subsequently will be transferred to the Arroyo Ranch Homeowner’s Association (HOA) and such shall be noted on the final plat.

FISCAL IMPACT
Although a fiscal impact analysis has not been conducted on this specific project, all new development will have an ongoing fiscal impact on the City. The development is responsible for construction of all infrastructure necessary to serve the site and will generate one-time revenue for the City through payment of permits, construction sales tax and development impact fees. Longer term fiscal impacts include increased demands for municipal services, the costs of which may or may not be offset by increased property values/tax levies, city sales tax, state shared revenues and the increased demand for commercial and retail development. Any areas that will be maintained by the city are constructed by the developer and then conveyed to the city two years after construction.
BACKGROUND AND PREVIOUS ACTIONS
The property is currently zoned PAD under the Arroyo Ranch Final Planned Area Development (PAD), which was approved by City Council on December 15, 2014, by Ordinance No. 2014-1316. On March 28, 2016, City Council approved a preliminary plat for all the property rezoned by Ordinance No. 2014-1316, including the platted property.
A Final Plat for Arroyo Ranch was approved by City Council on May 22, 2023. Under the Goodyear City Code, the approval of a final plat expires if the final plat is not recorded within 90 days of the date the final plat was approved, unless an extension is obtained. The initial 90-day expiration date for this final plat was August 20, 2023.
On August 18, 2023, the expiration date of the final plat was administratively extended for 90 days (until November 18, 2023) pursuant to section 15-2-5(I)(1), upon a determination that the requirements set forth in section 15-2-5(I)(1) had been satisfied.
On November 13, 2023, just before the administrative extension was set to expire, another 90-day extension was approved by City Council, pursuant to section 15-2-5(I)(1) of the Goodyear City Code. That extension expired on February 16, 2024. A new final plat approval is necessary for the applicant to proceed with their development project.

STAFF ANALYSIS
The Final Plat for Arroyo Ranch was not recorded under the original approval or subsequent extensions because the applicant needed additional time to coordinate with the homebuilder and finalize agreements. Because the approval of the final plat as extended has expired, the property owner is required to obtain council approval of a new final plat subdividing the property. The property owner is asking Council to reapprove the Final Plat for Arroyo Ranch previously approved on May 22, 2023. Staff supports the request because there have been no changes to the Subdivision Regulations or the Engineering Design Standards since the Final Plat for Arroyo Ranch was submitted and recommends the approval of the Final Plat for Arroyo Ranch attached hereto subject to the stipulations set forth above.
