SUMMARY
Acceptance of three (3) Water Line, Fiber Line and Access Easements and one (1) Water Line and Access Easement as required for the continued development of the Estrella development from NNP III-Estrella Mountain Ranch, LLC, a Delaware limited liability company.
Recommendation
Accept three (3) Water Line, Fiber Line and Access Easements and one (1) Water Line and Access Easement from NNP III-Estrella Mountain Ranch, LLC, a Delaware limited liability company. (Linda Beals, Real Estate Coordinator)
FISCAL IMPACT
There will be no fiscal impact to the city in the fiscal year 2021 or future years with the acceptance of this easement.
BACKGROUND AND PREVIOUS ACTIONS
On April 23, 2018, Council approved the Participation and Development Agreement regarding the construction and financing of Phase 1 of the City’s Surface Water Treatment Plant and related infrastructure (“Development Agreement”). This agreement included requirements for NNP III-Estrella Mountain Ranch, LLC, a Delaware limited liability company (“Newland”) to design and a 30-inch water line from the intersection of Estrella Parkway and Cotton Lane, to the intersection of Estrella Parkway and Willis Road, and to dedicate the associated water line easements. The construction of the 30-inch water line will provide treated surface water from the City’s surface water treatment facility to the Estrella master-planned community.
On December 10, 2020, the City entered into an Infrastructure Reimbursement Agreement with Newland providing for the placement/construction of fiber optic conduit together with the construction of the 30-inch water line and the reimbursement of the costs to design and construct the fiber optic conduit. (“Reimbursement Agreement”). This fiber optic conduit will facilitate the expansion and upgrade of the City’s communication systems.

STAFF ANALYSIS
Staff has reviewed the construction plans for the 30-inch water line and the fiber optic conduit. As part of the review, staff requested that Newland provide the attached easement documents, which are required per the terms of the Development Agreement and the Reimbursement Agreement. Accordingly, staff recommends the acceptance of the three (3) Water Line, Fiber Line and Access Easements and one (1) Water Line and Access Easement from NNP III-Estrella Mountain Ranch, LLC, a Delaware limited liability company.
