SUBJECT: LEASE AGREEMENT EXTENSION FOR OPERATION OF BMX TRACK AND CONCESSIONS

SUMMARY

The City of Goodyear (City) currently leases a portion of the Public Works Campus to AZ Pro Trac, which operates a BMX track and concessions. This current lease agreement (Agreement) expires on December 31, 2025. City staff recommends the current Agreement be extended for an additional one-year term.

Approve the Second Amendment of the Agreement for the operation of the BMX Track and Concessions, and provide authorization and direction to the City Manager or designee to take actions and execute the necessary documents to carry out the intent of the Agreement. FISCAL IMPACT

The extension of the Agreement for the operation of the BMX Track and Concessions temporarily relieves the City of its responsibility to perform noxious weed and dust control on the vacant, unimproved portion of the leased property. Furthermore, the BMX Track and Concessions operations provide an economic benefit to the City through the generation of tax revenue.

BACKGROUND AND PREVIOUS ACTIONS

This site has been leased for its use as a BMX track since May 24, 2004. It provides Goodyear residents with a recreational amenity not otherwise available within the City. The current lessee has operated the site since December 2011 and their current lease is scheduled to expire on December 31, 2025, unless this Agreement extension is executed. In lieu of the rent paid to the City, the lessee provides City residents with a ten percent discount on all fees and charges.

It is the Lessee and the Parks & Recreation Department’s desire to amend the Agreement to extend the expiration of the lease term to December 31, 2026, and to permit riders aged three to seven years old to operate electric stability cycles on the BMX Track to make the BMX Track more accessible for children.  

All other terms and conditions of the Agreement shall remain the same and shall remain in full force and effect, including the City’s 30-day right to terminate.

STAFF ANALYSIS

The leased area is not currently needed for City operational needs. Until such time as the leased area is needed for operational needs, City staff support the leasing of the area. If the leased property was not in use, the City would otherwise be financially responsible for maintaining the area. 

Accordingly, the staff is recommending that the Council approve and execute the Second Amendment of the Agreement for the operation of the BMX Track and Concessions, included as Attachment A.
