SUBJECT: USE PERMIT FOR A CONVENIENCE USE (CAR WASH)

SUMMARY:

The request is for a Use Permit for a Convenience Use (Super Star Car Wash) proposed on an approximately 1.26-acre property zoned Planned Area Development (PAD) with an underlying zoning of C-2 General Commercial located east of the southeast corner of N. 166th Avenue and W. Indian School Road.

RECOMMENDATION:

  1. Conduct a public hearing to consider a request for a Use Permit for a Convenience Use (Super Star Car Wash) proposed on an approximately 1.26-acre property zoned Planned Area Development (PAD) with an underlying zoning of C-2 General Commercial for parcel 501-02-954 generally located south of W. Indian School Road and east of 166th Avenue within PV 303 East II Phase 1.
  2. Recommend conditional approval of the Use Permit request for a Convenience Use (Super Star Car Wash) proposed on an approximately 1.26-acre property zoned Planned Area Development (PAD) with an underlying zoning of C-2 General Commercial for parcel 501-02-954 generally located south of W. Indian School Road and east of 166th Avenue within PV 303 East II Phase 1 (the “Property”). (Kyle Abbott, Senior Planner)

STIPULATIONS:

The approval of the Use Permit is subject to the Conditions of Approval (Attachment G).

FISCAL IMPACT:

Although a fiscal impact analysis has not been conducted on this specific project, all new development will have an ongoing fiscal impact on the city. The development is responsible for construction of all infrastructure necessary to serve the site and will generate one-time revenue for the city through payment of permits, construction sales tax and development impact fees. Longer term fiscal impacts include increased demands for municipal services, the costs of which may or may not be offset by increased property values/tax levies, city sales tax, state shared revenues and the increased demand for commercial and retail development. Any areas that will be maintained by the city are constructed by the developer and then conveyed to the city two years after construction.

BACKGROUND AND PREVIOUS ACTIONS:

The Property consists of approximately 1.26 acres of land and is located east of the southeast corner of N. 166th Avenue and W. Indian School Road (Attachment A). The Property is zoned Planned Area Development (PAD) and has an underlying C-2 General Commercial zoning. The PAD zoning was approved on January 13, 2008, with City Council adoption of Ordinance No. 2007-1097. The Planned Area Development (PAD) with an underlying C-2 General Commercial zoning designation establishes convenience uses such as a car wash as a use that requires approval of a Use Permit.

The subject property is located within a commercial center known as the Triangle at PV 303. A Master Site Plan for the Triangle at PV 303 was administratively approved by staff on February 24, 2023.

This application for a Use Permit has not been previously presented to the Planning and Zoning Commission or City Council.

STAFF ANALYSIS

Current Policy:
A Use Permit requires review by the Planning and Zoning Commission and approval by the City Council following required public hearings. The process for the review of a Use Permit is set forth in Section 1-3-2 of the Goodyear Zoning Ordinance and in the City of Goodyear Administrative Process Manual.

Details of the Request:
The applicant is requesting approval of a Use Permit to facilitate the development of a Super Star Car Wash on property zoned PAD with an underlying zoning of C-2 General Commercial. The property is located east of the southeast corner of N. 166th Avenue and W. Indian School Road.
The conceptual site plan (Attachment B) includes an approximately 4,000 square-foot car wash facility. The site will include three (3) point-of-sale pay stations and 17 self-serve vacuum stations. The property will be accessible from W. Indian School Road and via an internal drive accessible from N. 166th Avenue. The on-site parking, as reflected on both the conceptual site plan and the conceptual landscape plan (Attachment C), will be provided in conformance with the approved Master Site Plan for the Triangle at PV 303 and applicable city standards.
The design for the building will utilize a variety of materials and colors, as shown on the conceptual building elevations (Attachment D) submitted with the use permit. The height of the building will be 30 feet to the top of the highest parapet, which is less than the 56-foot height limit permitted with the zoning for the property.
The proposed business hours of operation will be Monday through Sunday from 7:00 AM to 7:00 PM. The car wash will have approximately three (3) employees on site at any anytime.
Customers will have the option of vacuuming their car or entering the queue for the car wash first. Customers may pay for the car wash in one (1) of three (3) pay station lanes, after which they will complete a 180 degree turn and enter the wash tunnel facing west. After leaving the tunnel, customers can turn right at the internal driveway to exit onto W. Indian School Road or turn left at the internal driveway to approach the vacuum stations or exit onto N. 166th Avenue.
The vacuum stations include canopies to provide shade while customers vacuum their vehicles. The main building includes the car wash tunnel, an office, equipment space, and restroom. A noise impact study (Attachment E) was provided showing the noise decibel levels at various distances from the car wash. The noise impact study indicates that the project will not increase the existing ambient noise level at the nearest adjacent residential properties or pickleball courts. Additionally, staff has included a stipulation to require the noise levels generated by this car wash do not exceed 65 dB along the west property line of Lot 5 and along the property line of Lot 5 from the northeast corner of the Property to the southwest corner of the Property.

Evaluation Criteria:
Section 1-3-2 (Use Permits) and Section 4-2-2 (Convenience Uses) of the Zoning Ordinance provide Evaluation Criteria (Attachment H).

Luke Air Force Base:
The subject property is located within the vicinity of a military airport. Given the location of the property and the commercial nature of the proposed use, base operations will not be adversely impacted by this development.

Public Participation:
In accordance with the city’s Citizen Review Ordinance, a neighborhood meeting was held July 30, 2025, at the City Hall, Canyon Trails conference rooms. Notice of the neighborhood meeting was mailed to all property owners within 500 feet of the property on July 12, 2025, and a sign was posted on the property on July 15, 2025. Two members of the public attended the meeting. Topics discussed during the meeting included proposed building height, general support for building colors and elevations, and landscaping. One resident stated they were looking forward to the development.
Notices for the public hearings before the Planning and Zoning Commission and City Council on August 13 and August 25, respectively, included a notice mailed to the 20 property owners within 500 feet of the property on July 22, 2025, and a legal notice published on July 25, 2025, in the Arizona Republic, Southwest Edition. Additionally, the sign posted on the property on July 15, 2025, was updated to include the public hearing information on July 28, 2025.

STAFF FINDINGS:
As outlined herein, staff finds the proposed request for Use Permit to not be materially detrimental to persons residing or working in the vicinity adjacent to the property, to the neighborhood, or to the public welfare and that the proposed use is reasonably compatible with uses permitted in the surrounding area. Staff further finds the request for Use Permit will meet the additional evaluation criteria for convenience uses as established in Section 4-2-2 of the Zoning Ordinance.
