CITY COUNCIL ACTION REPORT
 
SUBJECT: FINAL PLAT FOR PHX 70 – PV303

SUMMARY

A Final Plat subdividing approximately 144.9 acres into two lots at the southeast corner of Indian School Road and Citrus Road.

Recommendation

Approve the Final Plat for PHX 70 - PV303, subject to stipulations. (Katie Wilken, Planning Manager)

STIPULATIONS

  1. Prior to recordation of the Final Plat for PHX70 - PV303, an in-lieu payment for 50% of the cost of a full median and full median landscaping for the section of W. Indian School Road and N. Citrus Road along or adjacent to the frontage of the Property.  The in-lieu payment shall be 50% of the actual cost of the full median and full median landscaping if the median and landscaping have been constructed and installed or if the payment is required before the full median and median landscaping has been constructed and installed, the payment shall be based on the estimated cost of the full median and median landscaping as determined by the City Engineer or his designee;
  2. Owner shall either construct traffic signals at the following intersections when warranted or provide an in-lieu payment to the City the proportionate share of the costs to install the required signals prior to recordation of this final plat or when requested by the City Engineer, or his/her designee, whichever is earliest. Owner’s proportionate share of the costs for the traffic signals at the following intersections are as follows:
    1. 25% at W. Indian School Road and Minnezona Avenue;
    2. 25% at W. Indian School Road and N. Citrus Road;
    3. 25% at W. Osborn Road and N. Citrus Road;
  3. Prior to recordation of the Final Plat for PHX70-PV303, all easement(s) required to support the development, as shown on this final plat, shall have been recorded by separate instrument(s) and the recording information for each easement added to this final plat;
  4. Owner shall comply with all federal, state and local laws, codes, ordinances, rules, regulations and standards, policies, guidelines, and conditions/stipulations of approval applicable to the development of the property, including but not limited to requirements in the City of Goodyear Design Standards and Policies Manual and City of Goodyear Subdivision Regulations regarding the dedication for and construction of off-site and on-site infrastructure and all stipulations of approval for the Preliminary Plat of First Park PV303 approved by the city on December 17, 2018. In addition, Owner shall comply with the terms of the PHX 70 Development Agreement recorded in the official records of Maricopa County at instrument 2019- 0334649, as it may be amended from time to time;
  5. Prior to recordation of the final plat, Owner shall submit an updated title report for the Property that reflects that the right-of-way and easements being dedicated and conveyed to the City of Goodyear on the final plat are free from all liens and encumbrances unless approved by the City Engineer or his designee upon the determination that the encumbrances will not impact the rights being conveyed to the City of Goodyear.  Owner  shall modify the final plat to reflect the current ownership and current lender, including on the final plat a Lender Consent and Subordination in a form approved by the City Attorney or his/her designee for all lenders with a security interest in the property being platted herein. Owner shall provide documentation acceptable to the City Attorney or his/her designee demonstrating that the party executing this final plat is authorized to do so; and,
  6. Prior to recordation of the final plat, Owner shall submit documentation that the existing MWD easements, including the prescriptive easement, encumbering the future and existing City Right of Way have been terminated.
  7. Any technical corrections to the final plat required by the City Engineer shall be made prior to the recordation of the final plat.

FISCAL IMPACT

Although a fiscal impact analysis has not been conducted on this specific project, all new development will have an ongoing fiscal impact on the City.  The development is responsible for construction of all infrastructure necessary to serve the site and will generate one-time revenue for the City through payment of permits, construction sales tax and development impact fees.  Longer term fiscal impacts include increased demands for municipal services, the costs of which may or may not be offset by increased property values/tax levies, city sales tax, state shared revenues and the increased demand for commercial and retail development. Any areas that will be maintained by the city are constructed by the developer and then conveyed to the city two years after construction.

BACKGROUND AND PREVIOUS ACTIONS

The preliminary plat for First Park PV303 was approved by the City Council on December 17, 2018.

STAFF ANALYSIS

The final plat substantially conforms to the approved preliminary plat, and, as set forth in the attached preliminary plat Council Action Report, the proposed subdivision is consistent with the General Plan and will not adversely impact the surrounding area.  Further, the proposed subdivision is consistent with the technical requirements of the city’s subdivision regulations and engineering standards, and provides for the orderly development of the property by identifying the required infrastructure needed to serve the development.
