SUBJECT: AUTHORIZE THE EXECUTION OF A UTILITY EASEMENT TO ARIZONA PUBLIC SERVICE COMPANY FOR THE SURFACE WATER TREATMENT FACILITY LOCATED SOUTHWEST OF MC 85 AND ESTRELLA PARKWAY

SUMMARY

Issuance of a Utility Easement to Arizona Public Service Company, an Arizona municipal corporation, is required for the construction and maintenance of electrical facilities necessary for the operation of the surface water treatment facility being constructed southwest of MC 85 and Estrella Parkway.
 

Recommendation

Authorize the execution of the Utility Easement to Arizona Public Service Company, an Arizona municipal corporation, required for the operation of the surface water treatment facility located southwest of MC 85 and Estrella Parkway. (Linda Beals, Real Estate Coordinator)

FISCAL IMPACT

There will be no fiscal impact to the City in the fiscal year 2021 or future years with the acceptance of this easement.

BACKGROUND AND PREVIOUS ACTIONS

Upon approval of Council Action 2017-5965, the city entered into the CAP/SRP Interconnection Facility Lease and Water Transportation Agreement with Salt River Project in February 2017.  This agreement provides for the transportation of the city’s allotment of Central Arizona Project surface water from their interconnection facility located at the Granite Reef Dam to a connection point at approximately Avondale Boulevard and Broadway Road.  In connection with this agreement, the city began development of a pipeline to convey the water from the connection point to a surface water treatment facility.

In January 2018, Council approved the purchase of approximately 28 acres of land located directly west of the wastewater treatment facility located at 4980 South 157th Avenue. The acquisition of this property was completed in February 2018. Since the acquisition of the surface water treatment facility property, the City has acquired the additional rights required to construct the raw water pump station and the pipeline.   All of these items are currently under construction.

STAFF ANALYSIS

As previously noted, the surface water treatment facility is currently under construction and requires the placement of electrical facilities by the Arizona Public Service Company, an Arizona municipal corporation (APS).  This easement is required in order for APS to construct, operate and maintain the electrical facilities necessary for the operation of the completed water treatment facility.
