RECOMMENDATION
ADOPT RESOLUTION NO. 2025-2490 DECLARING CITY PROPERTY AS PUBLIC RIGHT-OF-WAY FOR W. BROADWAY ROAD. (Colton Blyle, Real Estate Specialist; Bobby Ruiz, Civil Engineer)
FISCAL IMPACT
The proposed declaration of right-of-way will have no immediate fiscal impact on the city for the fiscal year 2026. W. Broadway Road will be maintained by the city after construction by the developer subject to a warranty period.
BACKGROUND AND PREVIOUS ACTIONS
The city of Goodyear owns real property generally located along the Bullard Wash that was acquired from the Flood Control District of Maricopa County. A portion of this property is identified with Maricopa County Assessor’s Parcel Number 500-07-022S and is approximately 5.46 acres and a separate parcel is identified with Maricopa County Assessor’s Parcel Number 500-81-006K and is approximately 13.28 acres (together the “City Property”). CRE-WPL Estrella Owner I LLC (“CRE-WPL”) is the adjacent property owner to the east of the City Property and is currently developing the land. As such CRE-WPL is required to construct roadways and dedicate right-of-way to meet development standards. CRE-WPL is constructing a section of W. Broadway Road and as part of the construction a portion of the City Property must be dedicated as right-of-way to allow CRE-WPL to construct W. Broadway Road. CRE-WPL has asked the city to declare approximately 3,519 square feet of the City Property as right-of-way to allow them to construct W. Broadway Road up to the Bullard Wash.
STAFF ANALYSIS
The portion of City Property CRE-WPL has asked to be declared as right-of-way is not currently being utilized by the city for maintenance or access to the Bullard Wash, and has been determined to not be necessary for the city to retain. City engineering staff have confirmed that the portion of the City Property described and depicted in Exhibit “A” of the Resolution is needed for the section of W. Broadway Road being constructed in support of the development of CRE-WPL’s property. City staff is recommending the adoption of Resolution No. 2025-2490, included as Attachment A, and declaring approximately 3,519 square feet as right-of-way for a section of W. Broadway Road.
