SUMMARY
The request is for a Use Permit for a Convenience Use (convenience store with a gas station) on an approximately 1.48-acre property zoned C-2 General Commercial located west of the northwest corner of W. Roosevelt Street and N. Estrella Parkway.

RECOMMENDATION
Approve the Use Permit for a Convenience Use (convenience store with a gas station) on an approximately 1.48-acre property zoned C-2 General Commercial located west of the northwest corner of W. Roosevelt Street and N. Estrella Parkway. (Kyle Abbott, Senior Planner)
STIPULATIONS
The approval of the Use Permit is subject to the Conditions of Approval (Attachment A) one of which restricts semi-trailer truck fueling and truck stop facilities from being constructed or operated on the property.

FISCAL IMPACT
Although a fiscal impact analysis has not been conducted on this specific project, all new development will have an ongoing fiscal impact on the city. The development is responsible for construction of all infrastructure necessary to serve the site and will generate one-time revenue for the city through payment of permits, construction sales tax and development impact fees. Longer term fiscal impacts include increased demands for municipal services, the costs of which may or may not be offset by increased property values/tax levies, city sales tax, state shared revenues and the increased demand for commercial and retail development. Any areas that will be maintained by the city are constructed by the developer and then conveyed to the city two years after construction.
BACKGROUND AND PREVIOUS ACTIONS
On 11/05/2025, the Planning and Zoning Commission held a public hearing for this item. After the staff presentation, the Commission asked questions to staff and the applicant; the applicant provided additional details about the desire for the Use Permit at this location. Following the questions, one (1) resident provided a comment card in support of the project but did not wish to speak. At the conclusion of the public hearing, the Planning and Zoning Commission voted 6-0 to recommend approval, subject to the Conditions of Approval which are included as Attachment A.
A Public Hearing notice for the City Council Meeting was published in the Arizona Business Gazette – Republic Edition on 10/17/2025, at least 15 days prior to the meeting; postcards were mailed to 70 adjoining owners, located within five hundred (500) feet of the Property, on 10/17/2025 and signs were posted/updated on the site on 10/17/2025.

STAFF ANALYSIS
Staff reviewed the applicant's information related to the Use Permit in order to evaluate the request. Information related to the Use Permit request, including an aerial photo, conceptual site plan, conceptual landscape plan, and conceptual building elevations are provided as Attachments B, C, D, and E, respectively. Additionally, to develop a recommendation on the request, staff conducted an evaluation of the relevant criteria summarized in Attachment F.
Staff recommends that the City Council approve the Use Permit, consistent with the Planning and Zoning Commission's recommendation.
