SUMMARY
First Amendment to the Intergovernmental Agreement (IGA) with the City of Glendale (Glendale) for landfill disposal services, removing language that previously allowed City of Goodyear (Goodyear) residents to use the Glendale landfill at the discounted IGA residential rate. The IGA amendment (Attachment A) is being requested by Glendale due to operational challenges and escalating costs associated with verifying resident eligibility and managing certain materials.

RECOMMENDATION
Approve the First Amendment to the IGA with Glendale for landfill disposal services, and provide authorization and direction to the City Manager, or their designee, to take action and execute documents necessary to carry out the intent of the IGA. (Adam Kurtz, Solid Waste Superintendent)
FISCAL IMPACT
There is no direct impact on this item. The proposed amendment does not affect Goodyear’s Solid Waste Program or utility rate structure. However, Goodyear residents who previously qualified for the discounted IGA residential rate ($35.58 per ton) will no longer be eligible and, if they choose to self-haul, will pay Glendale’s standard current public rate ($47.00 per ton). Glendale is making similar amendments to its IGAs with the cities of Peoria and Avondale.
BACKGROUND AND PREVIOUS ACTIONS
Goodyear and Glendale entered into an IGA in 2023, Contract C-23-0387, to allow Goodyear’s municipal solid waste vehicles to dispose of waste at the Glendale Municipal Landfill. As part of the IGA, Goodyear residents were also permitted to self-haul waste to the Glendale Municipal Landfill at the discounted IGA residential rate.
Glendale is requesting this amendment to remove the residential provision in the IGA, and is taking similar action on its IGAs with other municipalities. Glendale has communicated that the original intent was to support municipal operations, not to create a discounted public disposal option. This IGA amendment will be effective when both city councils approve it.

STAFF ANALYSIS
Glendale identified two primary issues necessitating this amendment:

1. Misuse of the Residential Rate by Businesses
Glendale has observed significant misuse of the discounted residential rate by individuals operating businesses (e.g., landscapers, construction companies, junk haulers).
- Glendale is unable to verify if Goodyear utility accounts are active.
- Glendale cannot inspect properties to confirm the origin of waste material. As a result, commercial operators have been leveraging a private-use rate not intended for business use.
2. High Cost of Automobile Tire Disposal
Glendale has noted increasing costs to manage and transport automobile tires to the regional tire processing facility in the Town of Queen Creek.
