SUMMARY
The Intergovernmental Agreement (IGA) with Maricopa County is for assistance with right-of-way acquisitions of properties from owners within unincorporated Maricopa County for traffic signal and roadway improvements, along Sarival Avenue from Yuma Road to Elwood Street.

RECOMMENDATION
Approve the IGA with Maricopa County for right-of-way assistance for roadway improvements on Sarival Avenue (CIP Project #42048), and providing authorization and direction to the City Manager, or designee, to take actions and execute documents necessary to carry out the intent of the agreement. FISCAL IMPACT
Under the terms of the IGA, the city will be responsible for the acquisition costs of right-of-way that Maricopa County may acquire on behalf of the city; however the funding for real estate acquisition is already included in the approved budget for the CIP project.
BACKGROUND AND PREVIOUS ACTIONS
At the December 12, 2022 regular meeting, Council authorized the expenditure of design funds for the Sarival Avenue (west half) Yuma Road to Elwood Street project (Project).
At July 8, 2024 regular meeting, Council authorized the acquisition of the right-of-way necessary for the Project by purchase, grant, or eminent domain with Resolution No. 2024-2419.
At the June 9, 2025 regular meeting, Council approved the execution of an IGA with Maricopa County for permitting, operations and maintenance for the Sarival Avenue widening project in Resolution No. 2025-2474, in addition to adopting Resolution No. 2025-2475, which approved CIP Project #42048.
At July 8, 2024 regular meeting, Council authorized the acquisition of the right-of-way necessary for the Project by purchase, grant, or eminent domain with Resolution No. 2024-2419.
At the June 9, 2025 regular meeting, Council approved the execution of an IGA with Maricopa County for permitting, operations and maintenance for the Sarival Avenue widening project in Resolution No. 2025-2474, in addition to adopting Resolution No. 2025-2475, which approved CIP Project #42048.
STAFF ANALYSIS
The Sarival Avenue Widening project (CIP Project #42048) includes the proposed improvements of widening the west side of Sarival Avenue between Yuma Road and Elwood Steet, a new traffic signal at Yuma Road and Lower Buckeye, additional travel lanes, streetlights, and a raised median.
To accommodate these improvements, the city must acquire land rights from residents residing in unincorporated Maricopa County. City staff have been in contact with all impacted Maricopa County residents. Any offers that are presented and not resolved through negotiation with each resident would require condemnation. This agreement allows the city to proceed with condemnation efforts for property outside of city of Goodyear jurisdiction, with the support of Maricopa County for applicable condemnation cases in the County's jurisdiction. The city would be responsible for the costs of condemnation and the costs for Maricopa County staff time, if necessary.
Staff recommends approving the IGA with Maricopa County (Attachment A), which is needed to allow the CIP Project #42048 to acquire the necessary right-of-way and easements outside of city limits with the support of Maricopa County.
