SUBJECT: RESOLUTION APPROVING DECLARATION OF ACCESS AND FACILITIES EASEMENT ON CITY-OWNED PROPERTY LOCATED ON ASSESSOR'S PARCEL NUMBER (APN) 500-83-008P

SUMMARY

The proposed easement (as described in Exhibit B in Attachment A) will provide notice of the city’s need for access to the Property (as described in Exhibit A in Attachment A) and for utilities to ensure any future acquisition of the Property will be subject to the use conditions of the easement.

BACKGROUND AND PREVIOUS ACTIONS

The city acquired the Property generally located on the west side of Estrella Parkway between Maricopa County Route 85 (MC 85) and the Buckeye Water Conservation Drainage District canal (Property) upon which the city has developed facilities and continues to develop plans for additional facilities to support city services. The improvements that have been developed on the Property include, by way of example but not limitation, water treatment facilities, wastewater treatment facilities, a dog park, a public works administration building, fleet facilities, storage facilities, and a BMX park. The city has plans for the continued development of city-owned and operated improvements on the Property. As the Property continues to be developed, the city will be constructing improvements to provide vehicle access to the Property from MC 85 and certain city-owned utility improvements required to serve portions of the Property.
 

STAFF ANALYSIS

It is anticipated that the State of Arizona will acquire a portion of the Property for the construction of a new State Route 30 that will include portions of the city Property the city needs to provide access to the Property from MC 85 and to construct utilities needed for the city to serve the Property. The creation of this easement provides notice of the city’s need for continued access and use of the Property, and will ensure any future acquisition of portions of the Property will be subject to the city's easement.

Staff recommends approving Resolution No. 2026-2507 (Attachment A), approving the Declaration of Access and Facilities Easement, referenced as Exhibit 1 to the Resolution.
