SUMMARY
Consideration of a waiver pursuant to Arizona Revised Statutes § 28-7209 that will allow the Arizona Department of Transportation (ADOT) to expedite the abandonment and transfer of its interest in a portion of the Camelback Road right-of-way (located west of State Route 303, extending to 169th Avenue) to the city.

RECOMMENDATION
Approve the waiver of the Four-Year Advance Notice of Abandonment and Pavement Quality Report, allowing ADOT to proceed with the abandonment of its interest in the right-of-way located west of State Route 303, extending to 169th Avenue, and authorize the Mayor, or their designee, to take actions and execute the necessary documents to carry out the intent of the waiver. FISCAL IMPACT
There is no direct fiscal impact associated with waiving the Four-Year Advance Notice of Abandonment and Pavement Quality Report. This section of right-of-way has already been annexed by the city and is currently maintained by the city pursuant to the existing Master Maintenance Agreement with ADOT. By proceeding with this abandonment, the city received one-time minor roadway improvements from ADOT in micro seal treatment and pavement striping at no cost to the city within the abandonment area.
BACKGROUND AND PREVIOUS ACTIONS
On November 17, 2008, the Council passed Ordinance No. 08-1146 extending and increasing the corporate limits of the city by annexing Camelback Road right-of-way from Cotton Lane to Village Parkway.
On October 21, 2011, ADOT established right-of-way to accommodate the construction of the Bob Stump Memorial Parkway (State Route 303 Loop) lying west of the Parkway by that certain Resolution of Establishment recorded in Document No. 2011-0887016 in the records of the Maricopa County Recorder’s Office in which ADOT acquired a section of the city's Camelback Road right-of-way.
ADOT has advised the city of its intent to abandon a portion of the Camelback Road right-of-way that it acquired from the city, which is currently maintained by the city pursuant to the existing Master Maintenance Agreement with ADOT.

STAFF ANALYSIS
Arizona' Transportation Board is empowered to abandon portions of state routes and state highways (collectively "state right-of-way'). Upon such abandonment, the state's interest in the roadway vests in the city, or if in an unincorporated area, the county, in which the roadway is located. Before state right-of-way can be abandoned, however, the right-of-way pavement has to be in "such a condition that additional surface treatment and major maintenance" of the right-of-way will not be required for at least five years, unless the board and the affected jurisdiction agree to waive this requirement. In addition, the board is required to provide at least four years’ advance notice to the jurisdiction who will be responsible for the state right-of-way upon the abandonment , unless the board and the affected jurisdiction agree to waive this requirement.
ADOT asked the city to waive the four-year advance notice requirement to allow the board to immediately abandon the right-of-way and transfer responsibility for the right-of-way to the city. ADOT submitted a report indicating that the right-of-way proposed for abandonment would not require additional surface treatment or major maintenance for at least five years. However, City of Goodyear staff identified necessary surface treatments, specifically microseal treatment and pavement striping to ensure the area would not require additional work within that timeframe. ADOT agreed to complete the requested improvements, and staff has confirmed that the microseal treatment and pavement striping have been completed within the abandonment area.
