CITY COUNCIL ACTION REPORT
 
SUBJECT: FINAL PLAT OF EL CIDRO PARCEL 5

SUMMARY

A Final Plat subdividing approximately 23 acres into 1 lot for a multi-family development at the intersection of South Cotton Lane and West Elwood Street.

Recommendation

Approve the Final Plat for El Cidro Parcel 5, subject to stipulations. (Katie Wilken, Planning Manager)

STIPULATIONS

  1. Prior to recordation of the Final Plat for El Cidro Parcel 5 (the “Final Plat”), a current title report, no older than 30 days from the submittal date of the mylars provided to the city for recording, shall be provided to the city and the mylar shall be updated to reflect current ownership of the property and lender information reflected in the current title report; and
  2. Prior to recordation of the Final Plat, documentation establishing the authority of the person(s) executing the Final Plat on behalf of the property owner shall be provided; and
  3. Prior to recordation of the Final Plat, the right-of-way needed for the construction of W. Elwood Street identified on the Final Plat as being dedicated by Separate Instrument shall be conveyed to the city and the conveyance deed shall be recorded in the Official Records of Maricopa County, State of Arizona and the recording information inserted into the Final Plat; and
  4. Prior to recordation of the Final Plat, a resolution declaring as right of way a portion of property owned by the City located within the Cotton Lane alignment shall be approved and recorded; and
  5. Prior to recordation of the Final Plat or the issuance of a permit for the construction of the improvements to Cotton Lane Owner is required to construct (the “Cotton Lane Improvements”), Owner shall remit to the city an in-lieu payment of $92,150.00 for the cost of half median and landscape improvements for the Cotton Lane Improvements; and  
  6. Prior to recordation of the Final Plat or the issuance of a permit for the construction of the improvements to Elwood Street Owner is required to construct (the “Elwood Street Improvements”), Owner shall remit to the city an in-lieu payment of $33,584.00 for the the cost of half median and landscape improvements for the Elwood Street Improvements; and
  7. Prior to the recordation of the Final Plat, Owner shall remit to the city an in-lieu payment of $168,750, which represents 25% of the estimated cost of a full traffic signal (all four corners) at the intersection of W. Elwood Street and S. Cotton Lane; and
  8. The access driveway onto S. Cotton Lane from the property shall be designed and constructed to allow only right-out access from the property onto S. Cotton Lane; and
  9. Owner is responsible for constructing all on-site and off-site infrastructure, including road improvements and utility infrastructure, needed to serve the portion of the Property included in any final plat subdividing all or part of the Property, which includes, but is not limited to the infrastructure described below; and
  10. Prior to the issuance of any certificate of completion, temporary certificate of occupancy and/or certificate of occupancy for any structure within the property, full half-street improvements (except for the construction and installation of a median and median landscaping) for the east side of Cotton Lane between Elwood Road and the northern boundary of Pioneer Street (the "Cotton Lane Improvements") shall be constructed at no cost to the City, and accepted by the City Engineer subject to the completion of the two-year warranty period; and
  11. Prior to the issuance of any certificate of completion, temporary certificate of occupancy and/or certificate of occupancy for any structure within the property, full half-street improvements (except for the construction and installation of a median and median landscaping) for the north half of Elwood Street along southern boundary of Property (the Elwood Street Improvements") shall be constructed at no cost to the City, and accepted by the City Engineer subject to the completion of the two-year warranty period; and
  12. The property owner and/or developer of each respective parcel shall post signage within all sales offices and/or leasing offices identifying the location of the Luke Air Force Base Accident Potential Zones (APZs), 65 Ldn and higher noise contours, and departure corridors, as well as the Phoenix-Goodyear Airport Traffic Pattern Area and noise contours per the Goodyear General Plan 2003-2013 (Policy B-3e of Section 9.2).  This display shall include a 24-inch by 36-inch map at the main entrance of such sales facility and shall include the approximate locations of the homes or apartments being sold or leased clearly depicted; and
  13. Any technical corrections to this final plat required by the City Engineer or his designee shall be made prior to the recordation of the Final Plat.

FISCAL IMPACT

Although a fiscal impact analysis has not been conducted on this specific project, all new development will have an ongoing fiscal impact on the City. The development is responsible for construction of all infrastructure necessary to serve the site and will generate one-time revenue for the City through payment of permits, construction sales tax and development impact fees. Longer term fiscal impacts include increased demands for municipal services, the costs of which may or may not be offset by increased property values/tax levies, city sales tax, state shared revenues and the increased demand for commercial and retail development. Any areas that will be maintained by the city are constructed by the developer and then conveyed to the city two years after construction.

BACKGROUND AND PREVIOUS ACTIONS

On August 19, 2019 City Council passed and adopted Ordinance 2019-1446 rezoning the property included within the Final Plat for El Cidro Parcel 5 rezoning the property to MF-18 with a PAD Overlay to allow for the development of a multi-family development that was to be known as Vita at El Cidro Ranch, but which will be developed under a new name by Isola Communities.  On August 24, 2020, City Council approved the Preliminary Plat for El Cidro Parcels 4 & 5, which included the property within the Final Plat for El Cidro Parcel 5.

STAFF ANALYSIS

As set forth in the attached preliminary plat Council Action Report, the proposed subdivision is consistent with the General Plan and will not adversely impact the surrounding area. Further, the proposed subdivision is consistent with the technical requirements of the city’s subdivision regulations and engineering standards, and provides for the orderly development of the property by identifying the required infrastructure needed to serve the development.
