Acceptance of four (4) Emergency/Government Services Access Easements for access to the Prologis Development located at the northwest corner of Yuma Road and Bullard Avenue and acceptance of a Special Warranty Deed for road right-of-way required for the traffic signal at the northeast corner of Bullard Avenue and Harrison Street.

1. Accept two (2) Emergency/Government Services Access Easements from Prologis Commerce Park 1, QOZB LLC, a Delaware limited liability company and two (2) Emergency/Government Services Access Easements from MREG Bullard LLC, a
Delaware limited liability company; and

2. Accept a Special Warranty Deed from MREG Bullard LLC, a Delaware limited liability company. (Linda Beals, Real Estate Coordinator)

There will be no fiscal impact to the City in the fiscal year 2022 or future years with the acceptance of these easements.
 

The Prologis Development is located at the northeast corner of Yuma Road and Bullard Avenue.  In order to accommodate the required emergency and government service vehicles into this development and the adjacent property to the north, the City is requiring the landowners provide Emergency/Government Access Easements along the Harrison Street alignment at both Bullard Avenue and 143rd Avenue. 
 
In addition, a traffic signal is required and has been constructed at the intersection of Bullard Avenue and Harrison Street.  This signal requires the dedication of additional road right of way.  MREG Bulllard, LLC has provided a Special Warranty Deed dedicating the required portion of the road right-of-way.
 

As previously noted, City staff has determined the Emergency/Government Services Access Easements and the Special Warranty Deed for road right-of-way are necessary to create the required access to the Prologis Development and portions of the adjacent development.
