CITY COUNCIL ACTION REPORT
 
SUBJECT: FINAL PLAT OF REV AT BALLPARK VILLAGE

SUMMARY:

A Final Plat subdividing an existing approximately 25 acre lot into 2 lots at the intersection of S Estrella Parkway and S Wood Blvd.

Recommendation:

Waive the requirement for a preliminary plat pursuant to A.R.S. 9.463.01(U) and conditionally approve the Replat of REV at Ballpark Village attached hereto, subject to stipulations. (Katie Wilken, Planning Manager)

STIPULATIONS:

  1. Any technical corrections to this final plat required by the City Engineer or his  designee shall be made prior to the recordation of the Final Plat;
  2. The Public Sales Report shall include a statement that REV at Ballpark Village is subject to attendant noise, vibrations, dust, and all other effects that may be caused by overflights and by the operation of aircraft landing at, or taking off from, the Phoenix-Goodyear Airport;
  3. The property owner and/or developer of each respective parcel shall post signage within all subdivision sales offices and/or leasing offices identifying the location of the Phoenix-Goodyear Airport Traffic Pattern Area.  This display shall include a 24-inch by 36-inch map at the main entrance of such sales facility and shall include the approximate locations of the homes or apartments being sold or leased clearly depicted;
  4. Prior to recordation of the Final Plat, the property owner shall submit an updated title report for the property and shall modify this plat to reflect the current ownership and current lender including on the final plat a Lender Consent and Subordination in a form approved by the City Attorney or his/her designee for all lenders with a security interest in the property being platted herein. The property owner shall provide documentation acceptable to the City Attorney or his/her designee demonstrating that the party executing this final plat is authorized to do so;

FISCAL IMPACT:

Although a fiscal impact analysis has not been conducted on this specific project, all new development will have an ongoing fiscal impact on the City. The development is responsible for construction of all infrastructure necessary to serve the site and will generate one-time revenue for the City through payment of permits, construction sales tax and development impact fees. Longer term fiscal impacts include increased demands for municipal services, the costs of which may or may not be offset by increased property values/tax levies, city sales tax, state shared revenues and the increased demand for commercial and retail development. Any areas that will be maintained by the city are constructed by the developer and then conveyed to the city two years after construction.

BACKGROUND AND PREVIOUS ACTIONS:

The property included within this replat was originally part of Lot 32 of the Final Plat for Ballpark Village-Wood Corporate Campus, which was recorded in the official records of the Maricopa County Recorder on July 21, 2008 at Book 996 of Maps Page 50.  Lot 32 was then split into Lots 32A and 32B by A Minor Land Division Map of Ballpark Village-Wood Corporate Campus Lot 32, which was administratively approved and recorded in the official records of the Maricopa County on October 30, 2017 at Book 1351 of Maps Page 42.

STAFF ANALYSIS

A portion of Lot 32B is being developed as the REV at Ballpark Village, a single family rental community.  The remainder of the Lot 32B is to be developed for a project titled PROS Apartments, which will be an apartment complex.  Because these are separate projects with different owners, separate lots need to be created for both projects.  The proposed replat creates two lots out of the current lot 32B.  Because of limitations in state law governing lot splits, a formal plat was required.  Because the replat only involves the creation of two lots, state law allows the City Council to waive the requirement for a preliminary plat, which is a requirement for final plats. 

The proposed subdivision is consistent with the General Plan and will not adversely impact the surrounding area. Further, the proposed subdivision is consistent with the technical requirements of the city’s subdivision regulations and engineering standards, and provides for the orderly development of the property by identifying the required infrastructure needed to serve the development.
