CALL TO ORDER
Chair Kaino called the Police Public Safety Personnel Retirement Board meeting to order at 9:00 a.m.

APPROVE MINUTES
 

MOTION BY Boardmember Joe Perry, SECONDED BY Boardmember Jay Mathias to APPROVE the minutes from the August 18, 2022 and October 4, 2022 Police Public Safety Personnel Retirement Board meetings. The motion carried as follows:

Review, discussion and possible action regarding the application and medical records for entry into the Public Safety Personnel Retirement System - Clay Dawson
 

MOTION BY Boardmember Joe Perry, SECONDED BY Vice Chair Michael Stewart to ACCEPT with no pre-existing conditions the application for Clay Dawson for entry into the Public Safety Personnel Retirement System. The motion carried as follows:

Review, discussion and possible action on the application and medical records for Accidental Disability - Alison Braughton (last on the August 18, 2022 agenda)
[This item was heard after item 4 to allow the applicant's representative to be present.]

Caroline Pilch, Yen, Pilch, Robaina, Kresin PLC, attorney for Alison Braughton, joined the meeting at 9:03 a.m.

The Board entered into Executive Session at 9:10 a.m.

The Board reconvened the Police PSPRB meeting at 9:29 a.m.
 

MOTION BY Boardmember Jay Mathias, SECONDED BY Vice Chair Michael Stewart that pursuant to the July 7, 2022 court order to send the application and medical records to an Independent Medical Examination (IME) with questions from the board. The motion carried as follows:

Discussion and possible action regarding Public Safety Personnel Retirement System and the return to work requirements including payment status for Leonard Ledbetter.
The Board discussed recent issues with the Arizona Public Safety Personnel Retirement System (PSPRS) not accepting ADA accommodations without the employee terminating employment from the employer.  Ms. Sorensen reported that the current direction PSPRS was taking was to have the member separate from the PSPRS eligible position and be subsequently employed in the non-PSPRS position.  She stated that in the future there would be two actions for the Board to take when involving an ADA accommodation; the first to address the disability application and the second to address the separation from the PSPRS position and the entry into a non-PSPRS position.
 
EXECUTIVE SESSION

Per ARS §38-431.03, upon a public majority vote of the members constituting a quorum, the Goodyear Police Public Safety Personnel Retirement Board may hold an executive session for any item on the agenda.
 

MOTION BY Boardmember Jay Mathias, SECONDED BY Boardmember Joe Perry to CONVENE an Executive Session. The motion carried as follows:
