Review, discussion and possible action on the reemployment of Leonard Ledbetter.

MOTION BY Boardmember Eric Webster, SECONDED BY Boardmember Joe Perry to CONVENE an Executive Session. The motion carried as follows:

AYE:
Chair Laura Kaino, Boardmember Jay Mathias, Boardmember Joe Perry, Boardmember Eric Webster

Passed - Unanimously

The Board entered into Executive Session at 1:31 p.m.

Chair Kaino reconvened the Board meeting at 1:48 p.m.

Leonard Ledbetter, applicant, is present at the meeting.  Chair Kaino addressed Mr. Ledbetter advising that the Board is taking this matter very seriously and the action today is what is within the purview of the Board.  She added that the Board was not sure if it would result in payment of the benefits from PSPRS at this time.

MOTION BY Boardmember Eric Webster, SECONDED BY Boardmember Jay Mathias having reviewed the information presented, I recommend the Board find that Leonard Ledbetter satisfies the requirements of A.R.S. § 38-849(E)(3)(c) because Leonard Ledbetter accepted a job reassignment as an accommodation in accordance with the ADA due to a disability that was directly related to the disability for which Leonard Ledbetter is receiving a benefit. Further, having reviewed the job description, the alternate contribution rate is not required because the position of Customer Relations Specialist is not ordinarily filled by a contributing PSPRS member. The action carried as follows:

AYE:
Chair Laura Kaino, Boardmember Jay Mathias, Boardmember Joe Perry, Boardmember Eric Webster

Passed
