CALL TO ORDER
Mayor Pizzillo called the Regular Meeting to order at 5:35 p.m.

MOTION BY Vice Mayor Laura Kaino, SECONDED BY Councilmember Brannon Hampton to APPROVE the appointments and re-appointments as listed. The motion carried as follows:

City Clerk Darcie McCracken administered the oath to those present.
 
CITIZEN COMMENTS/APPEARANCES FROM THE FLOOR
Kathy Rhone, a Goodyear resident, spoke about bicycle roadway improvements and requested the Council look at barriers to keep vehicular traffic separate from bicycles.  Mayor Pizzillo asked the Manager to follow-up.

2024 COUNCIL MEETING CALENDAR
 
RECOMMENDATION
Approve the 2024 Council Meeting Calendar.  (Darcie McCracken, City Clerk)
 
4.
APPROVAL OF NEW SERIES 12 (RESTAURANT) LIQUOR LICENSE FOR OREGANO'S PIZZA BISTRO
 
RECOMMENDATION
Recommend approval to the Arizona Department of Liquor Licenses and Control (DLLC) of Application No. 256315, a request by Steven David Dunsire, owner of Oregano's Pizza Bistro for a new series 12 liquor license. Oregano's Pizza Bistro is located at 15280 W McDowell Rd., Goodyear, AZ 85395. 5.
AUTHORIZATION OF EXPENDITURE OF CONSTRUCTION FUNDS FOR APPROVED CAPITAL IMPROVEMENT PROJECT #50050 – LOMA LINDA SITE IMPROVEMENTS
 
RECOMMENDATION
Authorize the expenditure of funds for the Loma Linda Pool Improvement project in an amount not to exceed $2,569,200. (Mike Beadle, Recreation Superintendent)
 
6.
DEDICATION OF RIGHT OF WAY FOR ROADWAY IMPROVEMENTS ON CITRUS ROAD
 
RECOMMENDATION
1. Authorize the acceptance and execution of a Special Warranty Deed from Citrus Land, Inc., conveying right-of-way needed for roadway improvements on Citrus Road as required by the City of Goodyear for the Abel Ranch Development.

2. Authorize the acceptance and execution of a Special Warranty Deed from Southwest Next NEC Indian School and Citrus, LLC, conveying right-of-way needed for roadway improvements on Citrus Road as required by the City of Goodyear for the Abel Ranch Development. APPROVE BUDGET AMENDMENTS
 
RECOMMENDATION
Approve budget amendments. (Ryan Bittle, Finance Manager)
 
8.
APPROVE EXPENDITURES TO REPLACE FIRE APPARATUS PUMPER UNITS 993, 994, AND 995, AND RELATED BUDGET TRANSFERS
 
RECOMMENDATION
Approve budget amendments and authorize expenditure of funds from the Fleet Asset Management fund earmarked for FY2027 in FY2024 to place an early order for the replacement of Fire Apparatus units 993, 994, and 995. (Kevin Devery, Fleet Superintendent)
 
9.
ADOPT RESOLUTION AND RENEW INTERGOVERNMENTAL AGREEMENT (IGA) BETWEEN CITY OF GOODYEAR AND TOWN OF GUADALUPE FOR JUDICIAL SERVICES
 
RECOMMENDATION
ADOPT RESOLUTION NO. 2023-2357 AUTHORIZING THE MAYOR TO EXECUTE AN INTERGOVERNMENTAL AGREEMENT WITH THE TOWN OF GUADALUPE FOR JUDICIAL SERVICES FOR CASES FILED PRIOR TO JULY 1, 2020. (Crystal Whelan, Court Administrator)
Council asked if this was a renewal and Court Administrator Crystal Whelan responded yes.  Council asked if the Court was up-to-date with case processing since they had been so long without a presiding judge and Ms. Whelan responded that yes the Court is current with all case processing.
 
10.
AMENDED AND RESTATED INTERGOVERNMENTAL AGREEMENT FOR PARTICIPATION IN THE CITY OF AVONDALE HUMAN TRAFFICKING TASK FORCE
 
RECOMMENDATION
Authorize the City Manager or designee to execute the Amended and Restated Intergovernmental Agreement (IGA) with the City of Avondale's West Valley Human Trafficking Task Force which shall supersede the previously approved agreement. (Santiago Rodriguez, Chief of Police)
 
BUSINESS
 
11.
ADOPT LAND USE ASSUMPTIONS AND INFRASTRUCTURE IMPROVEMENT PLAN; AND PROVIDE FOR AN EFFECTIVE DATE
Deputy Finance Director Jared Askelson presented information on the Land Use Assumptions and Infrastructure Improvement Plan.  Council asked if there were opportunities to make any adjustments.  Mr. Askelson responded, yes, but only adjustments reducing the fees would be allowed.
 

MOTION BY Councilmember Sheri Lauritano, SECONDED BY Councilmember Vicki Gillis to ADOPT RESOLUTION NO. 2023-2324 ADOPTING THE LAND USE ASSUMPTIONS AND INFRASTRUCTURE IMPROVEMENTS PLAN (IIP), PROVIDING FOR CORRECTIONS, SEVERABILITY AND AN EFFECTIVE DATE. The motion carried as follows:

12.
EMPLOYMENT AGREEMENT FOR NEW PRESIDING MUNICIPAL JUDGE
Human Resources Director Lyman Locket reviewed the process taken to select the new judge.  He then reviewed the employment agreement for Manuel Delgado as the new Presiding Municipal Judge.  

Council congratulated Judge Delgado and thanked staff and the Judicial Advisory Committee for their efforts to select the judge.

Judge Delgado introduced his family and thanked Council for this opportunity.

City Clerk McCracken administered the oath of office to Judge Delgado.
 

MOTION BY Councilmember Bill Stipp, SECONDED BY Councilmember Sheri Lauritano to APPROVE the Employment Agreement for new Presiding Judge Manuel Delgado. The motion carried as follows:

INFORMATION ITEMS
City Manager Wynette Reed reported that the Arizona Fall League triple header occurred on Saturday and Mayor Pizzillo threw out the first pitch with 1,411 people attending.

Council inquired about the BMX event that took place over the weekend.  Ms. Reed responded that information would be provided to Council.
 
FUTURE MEETINGS
Future meetings are tentatively scheduled as follows:
October 19, 2023 Council Retreat 8:30 a.m.
October 23, 2023 Council Meeting 5:00 p.m.
 
ADJOURNMENT
There being no further business to discuss, Mayor Pizzillo adjourned the Regular Meeting at 6:04 p.m.
